T he first three months of this year flew by and I’m welcoming spring with open arms! With strong sales that continued through the beginning of the year, construction continuing, and more businesses increasing capacity, we’re starting to feel a little more like ourselves these days. Now that we’ve moved through the first quarter of 2021, I can honestly say that things are looking more positive than they have in a long time. Last year was not the 75th Anniversary celebration for our Association that we were hoping for; however, I’m feeling thankful to all of our members for their dedication, flexibility, and determination to continue on our mission of providing a viable, healthy Association for the next 75 years and beyond. One of the most critical components of our Association is the sponsor program. Our Platinum, Master, and Product sponsors provide the means for us to provide valuable services and programs to our membership. Without our sponsors events like our annual golf outing and the BBQ on the beach would not be possible. I would like to express my deepest gratitude to our sponsors for their continued support this year. I would also like to welcome and thank Huber Engineered Woods as our newest Product Sponsor.

A few exciting things for our members that took place recently include NAHB’s IBSx, which kicked off on February 9th as a virtual experience with keynote speaker Mike Rowe of “Dirty Jobs.” The virtual show was quite different than our normal gathering for the International Builders Show, but there were a lot of valuable educational, as well as virtual networking opportunities. In addition, the annual awards took place during the three-day virtual event. As always, Shore Builders Association was well represented! Our Professional Women in Building of the Garden State was a finalist for mid-size PWB Council of the Year for its legislative and political advocacy, fundraising and community outreach. Rich Robinson was recognized by the Associates Committee with the Bill Polley Advocate of BUILD-PAC Award for his support and promotion of the National PAC. He also chaired the NAHB Membership Committee. We would also like to thank Dean Mon for his time as NAHB Chairmain of the Board early last year and for the past four years spent on the NAHB leadership ladder. In addition, thanks goes to Hank Kelly for holding NAHB positions as Area 2 Chair representing NJ & NY, and Codes Committee Chair. We would also like to recognize

Mike Kurpiel for serving as NJ State Representative to the NAHB Board, and as the first Associate member to serve as State Rep. He will continue to serve NJ as State Representative and was elected Moderator of the State Representative Caucus, consisting of representatives from the 50 states and Puerto Rico. He is the first Associate member to ever hold this distinguished position. We would also like to recognize Kelly Ann Zuccarelli for serving as Chair of the National Sales and Marketing Council. And, last but certainly not least, at the recent NAHB Sales and Marketing awards The Nationals, Rich Robinson was named the NAHB Associate of the Year. There is no shortage of SBACNJ Superstars at the national level! Thank you all for your hard work and dedication to the industry. We are so proud to have you as our members! One of our favorite events of the year, FAME, is scheduled as an in-person event on May 20th at the South Gate Manor in Freehold. The venue has updated their space to accommodate an outdoor/open air feature and has provided us with a level of comfort that we can safely hold our annual awards in-person this year. Committees are a vital functional of our Association. Make your membership more meaningful by getting involved. Become an active member of a committee! Committees general meet one hour, once a month

❑ ASSOCIATE MEMBERS, MEMBERSHIP SERVICES AND PROGRAMS: This committee works for the betterment and benefit of the SBACNJ membership. This committee is responsible for the BEAM (Builders Employing Associate Members) Award as well as the Associate of the Quarter nominations. This commit tee recruits new members, screens prospective applicants and works to retain current members. ❑ GOLF CLASSIC: This committee meets 6 times per year, beginning in February, to plan the SBACNJ Annual Golf Outing. As a committee member it is important to be available the day of the outing to work as an event volunteer. ❑ LEGAL/LEGISLATIVE & ENVIRONMENTAL: This committee interfaces with local and state municipalities to maintain good relations, provide exchange information flow, and oppose adverse government regulations on the building industry in Monmouth, Ocean, Middlesex and Mercer Counties. The committee considers challenging ordinances, practices, and policies of municipalities which are harmful to SBACNJ members. ❑ SALES & MARKETING: This committee promotes professionalism in sales and marketing and further educates the members on the latest ideas available to Builder and Associate members. This committee also plans the Annual FAME (Fabulous Achievement in Marketing Excellence) Awards Banquet. The committee keeps industry views before the public and creates a better public image of the Association and the role it plays in the community. ❑ YOUNG PROFESSIONALS: This committee promotes participation and increases opportunities for young professionals in the building industry by developing interesting programs that provide a forum for networking, continuing education, professional growth, development of leadership skills and access to a professional community. ❑ PROFESSIONAL WOMEN IN BUILDING COUNCIL: This council is recognized and chartered by NAHB and is dedicated to promoting, enhancing, and supporting home building and women in the home building industry. This council is open to all member companies and their employees. There is a fee of $50 per member to join the council and is open to men as well.

He was invited to participate as a judge for SBACNJ’s FAME awards. So impressed by the presentation ceremony and engagement of the members, Adam joined the association immediately and has been an active and productive member ever since. Adam shares his marketing expertise to promote and grow the association in so many ways. He is Chair of the SBACNJ Young Professionals Committee through

• Many roadway improvements within the IRZ will require a hardship exception and submission of a climate impact statement. • Technical changes regarding flood hazard area and net fill / flood storage displacement calculations. • Re-registration of approved projects every 180 days to re-certify consistency with the NFIP if work has not commenced. • Expansion of flood hazard regulated waters to include isolated waters that drain less than 50 acres, riparian zone expansions, and mitigation requirement enhancements. • Climate change related conditions will be added to wetland permitting and mitigation. • Removal of NJDEP delineated coastal centers from the Coastal Rules. The proposals are extensive and, if adopted as presented in the initial stakeholder sessions, will have statewide impacts on development and redevelopment. JACKSON FILL PERMIT ORDINANCE In connection with an action filed by NJBA, SBACNJ and several individual builders, on February 25, 2021 the New Jersey Superior Court invalidated Jackson Township's (the "Township") ordinance regulating soil and fill movement. The court invalidated the ordinance on procedural grounds finding that it was not properly adopted because it was not first referred to the Township’s Planning Board. The ordinance was, in effect, a development regulation and, therefore,

What’s in a name? In a pre-cursor to its contemplated New Jersey Protection Against Climate Change (“NJ PACT”) regulatory changes, the New Jersey Department of Environmental Protection (“NJDEP”) changed the name of its Land Use permitting program from the “Land Use Regulation Program” to “Land Resource Protection”. The name change was not just to create a new sound- alike acronym. Instead, it appears to signal an intentional shift toward enhanced environmental protection in the NJDEP permitting process anticipated with the coming of NJ PACT. NJDEP is taking action to implement the NJ PACT rule amendments pursuant to State mandates to amend regulations to “integrate climate change considerations, such as sea level rise and chronic flooding” and “prevent further increases of harmful greenhouse gas emissions”, and to promote the State’s clean energy goals. NJDEP commissioned and produced several reports guiding its effort, each adhering to the conclusion that a 17% probability exists that sea level rise (“SLR”) will exceed 5.1 feet by Year 2100. A few of the many contemplated regulatory changes informally discussed during recent NJDEP stakeholder sessions are listed below. • New regulatory inundation risk zone (“IRZ”) and Climate Adjusted Flood Elevation (100-year elevation plus five (5) feet) that will require certain buildings to be elevated an additional five (5) feet. • Development restrictions within the IRZ.

Planning Board review was required pursuant to the MLUL for confirmation of compliance with the Township Master Plan prior to adoption. The ordinance was adopted to govern management of soil and fill material in connection with development projects. In essence, it required anyone planning to import or export fill material in quantities exceeding a certain threshold first obtain a permit. NJBA and SBACNJ (along with the individual builders) filed action in June 2020 challenging the ordinance on the basis that the Township exceeded its authority both procedurally and substantively, and that the ordinance went beyond what was envisioned by NJDEP in creating a model ordinance for such soil fill import/export. While suit was pending, the Associations worked with NJDEP to effectuate NJDEP's release of a modified model soil fill ordinance. The Associations intend to continue to work with the Township in an effort to ensure that any redraft ordinance addresses the substantive concerns raised with respect to the nullified ordinance. COURT UPHOLDS SETTLEMENT APPROVING DEVELOPMENT In a recent Appellate Division decision, Plaintiff challenged the Borough of Franklin’s (“Borough”) and its’ Planning Board’s (“Board”) approval of a settlement agreement related to the development of property (“Property”). Plaintiff alleged that the Borough and Board failed to comply with Whispering Woods at Bamm Hollow, Inc. v. Middletown Township Planning Board (“WW”), which allows for a public hearing to approve a settlement of a prerogative writ action by a planning or a zoning board. The court affirmed the approval of the settlement. The Board had approved a prior owner’s plan to construct condominium and townhouse units on the Property. The Property was later sold, Moss v. Borough of Franklin

but the project was not constructed because the Borough rezoned the area for single family homes only. A subsequent owner filed an action against the Borough after being advised that the approvals had expired. In 2007, the parties settled the action pursuant to a consent order, under which the development of certain age-restricted housing units on the Property was permitted, and the Borough amended its zoning ordinances to create a new district to accommodate the project. However, the project remained unbuilt. In 2017, the new owners (“Owners”) of the Property entered into a consent order with the Borough to amend the 2007 consent order, and authorize the construction of certain units and remove all age restriction requirements. The Borough adopted a new ordinance allowing for the development. Despite this action, the Board denied Owners’ site plan application, and Owners filed a complaint challenging the decision. The action was resolved in 2019 by settlement agreement (“Agreement”). Under the Agreement, Owners agreed to submit a revised site plan application and the Board agreed to adopt a corresponding resolution. The Agreement also provided that a public hearing would be held per WW for approval of the Agreement and the site plan application. Prior to entering into the Agreement, the Borough provided public notice of the meeting to discuss the Agreement. At the hearing, the Agreement was discussed prior to the council voting to authorize the execution of the Agreement. In addition, Owners submitted a revised site plan application to the Board pursuant to the Agreement. A public hearing on the application was held by the Board and the Board approved the application. Plaintiff filed a complaint in lieu of prerogative writs against the Borough, the Board, and Owners, alleging that the meeting to consider Owners’ plans submitted under the Agreement violated WW. The trial court granted Defendants’ motions to dismiss Plaintiff’s

complaint. The trial court dismissed Plaintiff’s claim that the Borough’s approval of the Agreement was in violation of WW. The court reasoned that the procedures followed satisfied WW, as the Borough publicly discussed the Agreement during its regular meeting and the Agreement itself required Owners to apply to the Board under WW for approval of a revised and resubmitted site plan contemplated by the Agreement. Moreover, Owners’ resubmitted application was the subject of a duly noticed public hearing in compliance with WW. The Appellate Division affirmed substantially for the reasons set forth by the trial court. The appellate court further noted that nothing in WW suggests “that the public must be given wide latitude at a hearing to renegotiate the terms of an agreement settling an action in lieu of prerogative writs,” and WW only requires that a settlement agreement be “subject to public presentation, a public hearing thereon and a public vote.” This decision reaffirms the procedures to follow under WW when approving a settlement agreement with respect to a prerogative writ action. STORMWATER GREEN INFRASTRUCTURE NJDEP’s Green Infrastructure Stormwater Rule, adopted March 2, 2020, and is now in effect as of March 2, 2021. Major development projects that do not have pending applications that are complete for review prior to the March 2, 2021 effective date must design accordingly to satisfy the green infrastructure requirements. The technical requirements will be a work in progress, and developers are encouraged to consult with consulting professionals early in the project design stage to ensure that the new rule requirements are appropriately addressed in project design from both a substantive and timing perspective.

In 2014, I assumed ownership of the business, took back the original name, and the newWaltron Bull & Roberts was born.

Shortly after, we received a letter from the NAVY that stated we must operate and remain open, that under no circumstances should we close.We never skipped a beat. Our employees kept working andWaltron kept supporting all of its critical infrastructure customers throughout the pandemic.

Jon Guy is President and CEO of Waltron Bull & Roberts, a company that specializes in steam and water chemistry management. Keith Buscio, Vice President, Director of Public Relations, Provident Bank, spoke with Jon to learn more about the company’s success and to discuss how Provident helped Waltron during one of the toughest years the company has ever faced.

What are some of the changes you’ve had to make to your business that you never would have anticipated this time last year?

KB:

How has your business been affected by the pandemic?

KB:

JG: Founded in 1903 by chemists Irving Bull and Alfred Roberts,Waltron has a long history of expertise in water chemistry management. The company started as an analytical and consulting laboratory in lower Manhattan in NewYork City – a perfect location to sample, analyze, and make recommendations for the boiler water of the many steamships that called in to the major seaport there. In fact, our company pioneered the first modern boiler water treatment program, including the first nuclear water chemistry program on a commercial ship, and at one point had nearly half of the US merchant fleet under contract. When the core maritime business (and Bull & Roberts name) was sold in 1984, the company refocused on manufacturing analytical instruments and rebranded itself asWaltron.

JG: We have been monitoring the pandemic since the very early stages. In 2016, we opened a sales office in China. Our Chinese sales director went on lockdown for seven weeks starting with the Chinese NewYear in mid- January 2020.We anticipated our sales in China would take a hit, and they did. Sales set to ship in the months of February and March pushed into April and May. Just as China began to climb out of the worst part of their pandemic, our key European suppliers began to be impacted. We now had pent-up demand for instruments and spare parts coming from customers and no way to get enough products fast enough to meet demand. At the same time, we grew anxious about whether or not our Flemington headquarters would be put into the same restrictions as our foreign business partners.

JG: The sales that we coordinate typically require meetings at customer facilities, whether by our own employees or our many distributors around the world.While services dried up for a short period of time during all of this, we learned that we needed to become more creative when it came to keeping our customers engaged. Our customers are mostly essential businesses, for example, power plants that need to remain open but that rarely ever allowed anything but on-site sales calls.They were mostly closed to sales visits, so we started using video conferencing for our sales rep training, changed over to conduct virtual sales calls, and live-streamed specialized training sessions for customers. None of that existed before 2020.

What are some of the biggest challenges you’ve faced during the pandemic?

attentiveness to clients, and my early document preparation, in just a few days we received the funding we needed.Thanks to the program we kept everyone working without any reductions. The working capital also helped me accelerate R&D to bring more production back to the United States.That makes us less dependent on foreign suppliers, which proved to be a threat when the global pandemic hit Europe.

KB:

JG: For small business owners like me, there isn’t a lot of room for error, even in the best of times.We’re personally and financially committed to our companies like no one else. Our willingness to evaluate and accept risk (and uncertainty) is greater than the average person, but at the same time we have to remember that not everyone has that same risk tolerance. AtWaltron I needed to make sure employees not only felt secure and fulfilled in their jobs, but that their perspectives on health and safety were accommodated. Some employees chose to work remotely one or more days a week. Then again, not everyone in a manufacturing industry has the capability to work remotely. So, it was important to me to communicate to my employees that while working remotely, they owed it to their colleagues remaining on site to stay focused and productive.

How has Provident Bank helped your business through the pandemic? How have they demonstrated their commitment?

KB:

JG: The communication from the SBA team at Provident Bank was outstanding. Matt Flannery and his SBA lending team were incredibly responsive and the first to share information. He and his team were always able to explain new developments regarding the Paycheck Protection Program thoroughly and clearly. It was comforting to know that Provident Bank had my back and knew how to accurately handle the situation. This is what separates Provident Bank from other banks. I made sure to share my experience with Chris Martin, Provident’s Chairman and CEO, and explain how much Matt Flannery and the SBA lending team helped my business. I wanted him to know how proud he should be of his people. Even when the world is in complete disarray, Provident Bank has the resources and strategies to handle it, and they made it look effortless. That’s commitment you can count on!

How has the pandemic changed how you will do business moving forward?

KB:

JG: We prepared ourselves to seek additional funding and resources once we knew how bad this was going to be. My main concern was keeping our employees working.The SBA team at Provident Bank was extraordinary.Without a doubt, Provident’s attention to detail and commitment to its customers proved to be a real advantage for my business.The help I received from the SBA team, especially with the Paycheck Protection Program was flawless.
