Quick Issues Index – IBS Leadership Meetings 2022 Build Back Better • The House passed a scaled-down version of the Build Back Better Act prior to Thanksgiving, which eliminated several problematic tax increases included in earlier drafts • To pass the Senate, the bill requires unanimous support of all Democrats. However, Senator Joe Manchin (D-WV), after weeks of negotiating with the White House, announced in late December he could not support the House-passed bill. This brought all efforts to pass it to a halt. • If the bill is revived, it will have to undergo a significant re-write to earn Senator Manchin’s support. We expect Democrats to begin those discussions in the coming weeks, and we will remain engaged. For more information, contact JP Delmore, jpdelmore@nahb.org. • As part of the Build Back Better Act, House Democrats have proposed a complete overhaul of the existing energy tax incentives, many of which expired at the end of 2021. • The Build Back Better Act has stalled in the passage, adding considerable uncertainty to the future of these now-lapsed tax incentives. • Many of the changes proposed were positive, but some would diminish the utility of these credits moving forward. Of concern is the proposal to shift qualification of the Section 45L tax credit to participation in the Energy Star Program, which is a niche program.
