THE RED BARN Chapter 4: Remembering Uncle Ed By Richard Mabey Jr.

In early June of 1983, my dad, my Uncle Ed and I built a barn at the old Mabey Homestead, along Mabey Lane. By the end of June, the good Lord would call my Uncle Ed to begin a new life, far from Lincoln Park. This was to be the very last project that the three of us would ever work on. At the time, none of us knew that.

tally embarrassed. As I carried the two pizza box es to the table, in front of the wooden platform, my heart kept beating like a big old bass drum. My hands trembled a bit, as I placed the pizza boxes on the table. And I looked up and saw Devon smile this private smile at me, almost saying to me, “I gotcha boy. Old Uncle Ed’s been talking all about you, boy!” Dad invited the McCarthy’s to join us for lunch. But Nolan said he had to go to the doctor. Then Erin said, “but maybe Devon would like to join you all.” Upon which Devon shyly replied a kind of “Why not?” We talked beneath the pine trees that once bor dered our side of Mabey Lane. Devon talked about herself a little bit. Devon worked as a third-grade schoolteacher in Chicago. I remember that she spoke most briefly about how her boyfriend had most recently broken their engagement. The bot tom line of it all was that Devon was glad to get away from Chicago, to be with her aunt and uncle, and to come to know the charm of our little May berry. I remember that I had bought two big bot tles of Dad’s Root Beer soda. One of the bottles must have flipped around a bit in my car, on the way home from the pizza parlor. Because when I twisted open the bottle cap, the soda fizzed up a bit high and squirted onto my T-shirt. I felt like a complete knucklehead. Here I was, in the presence of this really cute girl, and of all times the soda bottle went and betrayed me. Devon laughed when the soda sprayed up out of the big bottle and landed all over my shirt. I want ed to crawl under the table. But once again, Devon gave me this private smile, that almost seemed to

We had begun building the red barn, on a Satur day. As a young man, I faithfully kept a daily jour nal of the day’s events. I am immensely grateful that I saved those hand-written diaries. It was now Tuesday. We had successfully finished building the platform for the red barn. It was a little after high noon, we were placing the vertical two-by fours, to act as the foundation for the walls of the barn. I remember, out of the blue, Dad said to me, “Richie, why don’t you run downtown and pick up a couple of pizzas for us?” I remember telling my Dad, “No problem.” When I returned home, with my two pizza pies in hand, there was Dad and Uncle Ed talking to the neighbors, who lived across the way on Mabey Lane. Nolan and Erin McCarthy lived in the old canal house. They were engrossed in conversation with Dad and Uncle Ed. Nolan’s brother’s daugh ter, Devon, had been visiting her aunt and uncle for the summer. Devon was 25. She had incredibly beautiful red hair. Freckles adorned her face. And she had the most sensitive green eyes that I had ever seen. I was 29 at the time, and I confess that I secretly had a most painful crush on Devon. As I opened the door to my old Ford Galax ie 500, I couldn’t help but to hear my Uncle Ed talking. Uncle Ed was showing Devon the latest issue of The Lincoln Park Herald, the down-home weekly newspaper that brought the town’s news to the good people of Lincoln Park. I had been bless ed with getting a front-page story published that week. “That’s just one of the many articles my nephew’s written. Yes sirree, that boy’s smart as a whip. He keeps them big wheel councilmen on their toes,” Uncle Ed bragged on me, with a voice tone that

The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Sometimes, something that looks simple or easy at first glance, can turn out to be quite complicated and much, much more difficult. Estate planning is one such thing. Search online, and you’ll find tons of online do-it-yourself estate planning services. On social media, you’re probably seeing ads for products such as Will & Trust, Legal Zoom, or Suze Orman’s estate planning kit. Such forms are typically inexpensive. Simple Wills, for example, are often priced under $100, and you can complete and print them out in a matter of minutes. There are hidden complications in do-it-yourself estate planning that will make things a lot LESS simple, for you, and for those you love. (Just read a few of the comments on a recent ad, pictured here!) This is one case in which something is not better than nothing, and here’s why: A False Sense of Security Creating a DIY Will online may lead you to believe that you no longer have to worry about estate planning. After all, you got it done, right?

Wills and increasingly non-traditional families, tens of thousands of families (and millions more to come) have learned the hard way that trying to handle estate planning alone cannot only fail to fulfill this purpose, but it can also make the court cases and conflicts far worse and more expensive. The Hidden Dangers of DIY Wills From the specific state you live in and the wording of the document, to the required formalities for how it must be signed and witnessed, there are numerous potential dangers involved with DIY Wills and other estate planning documents. Estate planning is most definitely not a one-size-fits-all deal. Even if you think you have a simple situation, if you have children, that’s almost never the case. The following scenarios are just a few of the most common complications that can result from attempting to go it alone with a DIY Will: • Improper execution: For a Will to be valid, it must be executed (i.e. signed and witnessed or notarized) following strict legal procedures. • Court challenges: Before the assets covered in a Will can be transferred to your heirs, the Will must go through the court process called probate. During probate, creditors, heirs, and other interested parties have the opportunity to contest your Will or make claims against your estate. Though Wills created with an attorney’s guidance can also be contested, DIY Wills are not only far more likely to be challenged, but the chances of those challenges being successful are much greater than if you have an attorney drafted Will. • Thinking a Will is enough: It is almost never the case that a Will alone is sufficient to handle all of your legal affairs. In the event of your incapacity, you would also need a health care directive and/ or a Living Will, plus a durable financial power of attorney. In the event of your death, a Will does nothing to keep your loved ones out of court. And if you have minor children, having “just a Will” could leave your kids’ at risk of being taken out of your home and into the care of strangers. Even if only temporarily, this can be a traumatic experience for your child. In many ways, DIY planning is the worst choice you can make for the people you love because you think you’ve got it covered when you most certainly do not. If you’ve yet to do any estate planning at all, have DIY documents you aren’t sure about, or if you have a plan created with another lawyer’s help but it hasn’t been updated or reviewed in more than a few years, you should meet with an experienced Estate Planning attorney. DO YOU HAVE UMBRELLA COVERAGE ? By John Bazzurro Over the past several weeks, I have had two unfortunate situations that have arose in my practice that have prompted me to write this article concerning something called “umbrella coverage.” Despite its name, this type of insurance coverage has nothing to do with protection from weather events. As will be seen below, “umbrella coverage” is another layer of insurance coverage that is recommended in order to properly protect you and your family against judgments and lawsuits arising out of your negligence or the negligence of a family member within your household. In one case, my client was signi fi cantly injured in a motor vehicle accident with a 17-year-old boy who had only recently received his drivers’ license. Th e automobile insurance policy on the young man’s vehicle had policy limits of $250,000.00 for the bene fi t of parties injured as a result of the negligent operation of the vehicle. Th e young man and his family live in a large home in an upper class Township within Monmouth County and, as such, it would seem that he and his family would have a reason to protect their assets over and above the $250,000.00 policy limits of their automobile insurance. Unfortunately, they did not have additional insurance coverage and, as such, given the signi fi cant nature of my client’s injuries, their personal assets could now be in jeopardy in the litigation. In another case, a client of mine caused a signi fi cant accident in which a number of people were injured. Although I only represented her on the tra ffi c tickets she received, both her and her husband inquired as to whether or not it was likely that they were going to be sued for personal injuries arising out of the accident. Similar to the family above, my client and her husband only had automobile insurance with $300,000.00 in policy limits to cover the injuries sustained by the other individuals involved in the accident. Th e client’s husband was a medical professional and, once again, had signi fi cant assets over and above the $300,000.00 policy limits which he and his wife should have protected. When I asked them if they had “umbrella coverage” to further protect them, they did not know what it was. At a minimum, if you own a home and an automobile, you should have an automobile insurance policy that protects you against injuries you cause in a motor vehicle accident as well as homeowners’ insurance which protects you against injuries caused by you and your resident family members for negligent acts (other than an automobile accident) that cause injuries to others. All homeowners’ insurance policies contain an “automobile exclusion” for which the homeowners’ policy will not cover injuries to others as result of the operation of an automobile. If either of these policy limits are insu ffi cient to “pay for” the injured parties’ injuries, “umbrella coverage” is intended to supplement your policy limits. Typically, “umbrella coverage” is purchased to supplement the above referenced automobile insurance policy limits and homeowners’ coverage policy limits; o ft en at a reasonable rate. Such “umbrella coverage” is utilized and necessary to protect assets when your assets are greater than the policy limits a ff orded by either your homeowners’ policy or motor vehicle policy. Unlike homeowners’ coverage, “umbrella coverage” does not contain an “automobile exclusion” and, as such, would be available to supplement automobile insurance coverage in the two scenarios described above. Accordingly, while it is a good idea to review your insurance coverages on a regular basis with a quali fi ed insurance agent or broker, you should always be cognizant of the amount of your automobile coverage and homeowners’ coverage in relation to the amount of assets you intend to protect. Importantly, regardless of the amount of assets you presently have, a judgment against you arising out of your negligent acts may last for 20 years or more and, therefore, assets which you accrue in the future may also be in jeopardy. So, regardless of the level of your present assets, it may be a good idea to protect your future with such “umbrella coverage.” Should you have any questions concerning this article, please feel free to contact my o ffi ce or, alternatively, immediately discuss these issues with a quali fi ed insurance agent or broker. The Homeowner and Contractor Bridging the Gap By Vicki Quarant Starting a home renovation or build can be very ex citing, but it can also lead to conflict between home owners and their contractor. Disputes happen from budgets misunderstandings, timeline discrepancies and everything in between. In this article. I am hop ing to bridge the gap for homeowners and their con tractors. There must be excellent communication with your contractor on many and all things or you will de lay your project, for many months to possibly years. The first thing to do is your research on the contrac tor, yes sounds like everyone already knows that but I mean really do your research. For instance, get refer ences, check to see if their license with the state is cur rent as well as making sure they have general liability and workman’s comp insurance. You should also try to keep an eye out to see if they are organized. You should observe how he conducts his business. Are they on time for the initial meeting with you, or does he reschedule appointments often? If they happen to come with their work vehicle, see if you can notice if it’s neatly kept or messy. If so, then this is exactly how they will run your job. Another way to see their work is to ask them what current jobs they are doing, not past jobs but jobs that are in progress. Any reputable con tractor that has pride in his work will be happy for you to visit his sites. Believe me, I have been in this industry for more than 25 years and I have seen everything. A good contractor will not have anything to hide. Keep in mind this will be a job for you in a way, and it is up to you to do your own due diligence on making sure you do your best to pick the right contractor. It will be well worth it in the end! You do not want to have a contractor that you need to constantly keep tabs on. Below is a recap of things that need to be a must. • Great communication • The organization and cleanliness of their current jobs. • They must have a valid state license and updated insurance • Reliable and professional sub-contractors (electri cians, plumbers, etc.) Once you find a contractor that you like and are comfortable with, you need to make sure his contract is a good one. Read it over well or have an attorney review it and explain it to you. Often, too many home owners are anxious and excited to get their project started and glance through the contract and sign it, which can leave room for major problems. It is worth the few hundred dollars to pay an attorney to be safe and sure of what you are signing. Trust me. These are just the first steps in your new journey to take and to understand that there are many more steps to it, but first things first, remember your project must be built on trust and collaboration with both parties.
