DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. I Remember Dad: AN EARNEST LETTER I WROTE TO MY FATHER By Richard Mabey Jr.
It was in late September of 1974, that I had most recently turned 21 and was now well into my fourth quarter at Sherman College of Chiropractic in Spartanburg, South Carolina. I remember keeping in touch with the events and happenings in Lincoln Park through three main news papers; The Lincoln Park Herald, Scout ing Gazette of Troop 170 and the monthly newsletter of the First Reformed Church of Lincoln Park. I gratefully received all three publications in the mail, while I was away at college. September of 1974 was also a milestone for my beloved father. For Dad was begin ning his ninth year, serving as Scoutmas ter of Boy Scout Troop 170. My father had been elected, by the Troop Committee, to become Troop 170’s newest Scoutmaster back in September of 1966. It was in late September of 1974, that my dad and I were both to face unique life challenges. I had gotten back my first Or ganic Chemistry quiz test. I was humiliat ed to the end of the earth. I had gotten a D on the quiz. What caused me to go deep within myself and wonder if I would make it through chiropractic college, is that I had ever most diligently studied for that quiz. I was all so devastated. It was a day or two, after I had gotten back my first Organic Chemistry quiz, that
letter that this disgruntled father wrote to all the scout families of Boy Scout Troop 170. For me, it was a strange and bewildering thing. I was going to write my father, to consult him and ask him his advice about my poor grade in my latest Organic Chem istry quiz. However, a great epiphany fell upon, as if an angel from Heaven had spo ken to me. It was now my time, to encour age my father. Dad had always been there for me, to give me encouragement in my childhood and youth. Now, Dad needed my encouragement. After school one afternoon, at my desk in my bedroom, I wrote my heart out to my father. I told Dad how much he had helped me in scouting. From the many week-long hikes of the Appalachian Trail we had tak en, to the many times we paddled the Del aware River, for week-long adventures, to gether in a canoe. I wrote my father that he was by far, one of the best Scoutmasters in the entire Morris and Sussex Area Council. I told my father, in that letter, that I loved him very much. It was about a year before Mom passed away, that she told me that my letter of en couragement to Dad meant the world to him. Mom told me that Dad was seriously thinking about resigning as Scoutmaster of Boy Scout Troop 170. That he just couldn’t

I received a letter from my dear mother. Mom was very troubled and deep ly concerned for Dad. One of the scout fathers was creating havoc within Troop 170, spreading terrible lies about my father. This disgruntled scout father had already transferred his son from another scout troop to Troop 170, because of problems he saw with that scout troop. This unkind man began sending letters to all the scout families of Boy Scout Troop 170, that my father was not qualified to be a Scoutmaster. This upset scout father told the Assistant Scoutmasters and Committeeman that Dad used the word “ain’t” in his conversations and that Dad did not use proper English when talking with the scouts. This misguided scout father went on to accuse my father of taking money from the troop treasury. In truth, it was just the opposite, dozens upon dozens of times, Dad paid for the summer camp tuition for quite a few of the scouts of Troop 170, whose families were going through a rough time. In Mom’s letter, I remember that she wrote me that she walked out to the old red barn, on a Saturday afternoon. Mom found Dad sitting on the old bench, that we had in the red barn, crying his eyes out, holding the horrible
take any more of the false accusations that this disgruntled scout father was hurling at him. From her hospital bed, Mom held my hand and thanked me for writing such a heart-felt letter to Dad. Mom then told me that it was my encouraging letter that gave Dad the inspiration to stay on as Scoutmaster of Troop 170. I do remember that I dug deep within myself and committed myself to studying more for my Organic Chemistry class. I am no expert in chemistry, but I did manage to earn a grade of C, for my final grade that quarter. Chem istry just did not come easily to me. I loved my father with all my heart and soul. I get so upset when I hear people say that they are disgusted with their children, regardless of what age they are. It always upsets me to hear people speak unkindly of their parents. Life is short. DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. AREAS OF PRACTICE: With the recent global surge in antisemitism, it has become increas ingly urgent for educators to develop analytical tools to contextualize current events, distinguish antisemitism from legitimate criticisms, and address sensitive topics with historical depth and nuance. This February, the Rutgers Bildner Center presents “The History of Antisemitism—A Contemporary Problem with a Long History,” a free three-session vir tual mini-course that explores the historical evolution of antisemitism from antiquity to the present. Participants will gain essential context to understand recurring tropes, Jewish responses across eras, and modern manifestations, equipping them to lead informed classroom discussions. The course will be taught by Dr. Daniel Ross Goodman, a professor of Jewish thought and theology at St. John’s University and the Allen and Joan Bildner Visiting Scholar at Rutgers. Pedagogical discussions will be led by award-winning teacher Colleen Tambuscio, founder of the New Jersey Council of Holocaust Educators. Designed for middle and high school teachers with at least one year of teaching experience, the mini-course will be held on Wednesdays, Feb ruary 4, 11, and 25, from 4:00 p.m. to 6:00 p.m. Educational materials are included and participants can earn six hours of continuing education credit. Dear, kind Grandpa, Watson Mabey, when he was a younger man.
PRECIOUS BE THE LOVING HEARTS OF FAMILY ELDERS By Richard Mabey Jr.
My paternal grandfather, Watson Mabey, was one of the wisest men I have ever known. He was all so well versed on the subjects of botany, the ways of wildlife and applied physics, from his days of working as the Chief Engineer of Incline Plane Ten East. From the time I was seven years old, Grandpa and I would walk the wood ed path, behind the old Mabey Homestead. On a Summer’s morning, we would finish breakfast, then leave the warmth and comfort of the kitchen of the old family homestead, walk to Mabey Lane, walk down the country road, then begin out journey to traverse the maple, elm and oak to the banks of the old Morris Canal. I remember that Grandpa had a leather sack that hung over his shoulder. Inside Grandpa’s shoulder bag would be two sandwiches, two apples and some oatmeal cookies that Grandma made and packed for us. Also, inside the leather sack would be a thermos of apple juice. I remember just how much Grandpa loved apple juice. As we would walk the forest path to the tow path of the old canal, Grand pa would point out to me which wild plants were edible and which ones were poisonous. We would take a moment to watch the deer drink from the flowing waters of the babbling brook that ran through the forest to the old Morris Canal. When we reached the bank of the canal, we would perch up upon the
stones of the remaining foundation of the old Mabey Ice House. The very ice house that Grandpa’s father, William Mabey, owned and operated during the heyday of the Morris Canal. As we would eat our lunch, Grandpa would explain to the me the intricate and complex process of the workings of Incline Plane Ten East. Grandpa would sip his apple juice and chomp on his sandwich, made with home made bread. A twinkle would spark in Grandpa’s eye as he told me golden tales of life along the old Morris Canal. As I approach 72, fighting Hypertrophic Cardiomyopathy, I find myself becoming more and more appreciative of the times I spend with my dear, kind, beloved grandfather. I loved him very much. I miss him dearly. I’d give up my entire comic book collection and my collection of first edition novels, to have just five minutes to once again walk the forest path with dear old Grandpa. If they are still with you, in this physical life, love the elders of your family. Cherish your time with them. For there will come a time when they will pass from this earth. Life is short. Painfully short. Truly, the three key elements of the loving heart are forgive, forgive and forgive. Richard Mabey Jr. is a freelance writer. He has recently had two books pub lished.
