DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. I Remember Dad: THE PRECIOUS WISDOM OF FAMILY ELDERS By Richard Mabey Jr.

In May of 1960, I was completing Mrs. Kiick’s First Grade Class at Chapel Hill School. My sister, Patricia, was a year old. My great grandmother, Dora Mabey had passed away, a year ago. Great Grandma Mabey was our link to the past, to an other time, another era. She was born on the fourteenth of October in 1873, less than 10 years after General Lee met Gen eral Grant at Appomattox Court House. Great Grandma Mabey went Home to be with the Lord in May of 1959, at the age of 85. In November of 1959, Mom and Dad, and my sister Patti and I moved into the old Mabey Homestead. My father was very close to his grandmother. I was only five years old at the time, but we would often visit Great Grandma Mabey at the old Mabey Homestead. We lived in Clif ton at the time. My great grandmother would be sitting in her rocking chair. She would tell my father, with great convic

tion, that Dad was destined to guide boys become strong and moral men. This was only a few months before Great Grandma Mabey passed away. Fast forward to September of 1964. I first joined Boy Scout Troop 170, of Saint Andrew’s Episcopal Church in Lincoln Park, a few days after turning 11. By Oc tober of 1964, Dad signed up to become the newest Committeeman of the troop. Then, in September of 1966, Dad was chosen unanimously by the Troop Com mittee, to become the new Scoutmaster of Troop 170. Thus, fulfilling Great Grand ma Mabey’s prophecy of early 1959. I often wondered how it was that Great Grandma Mabey knew that Dad was go ing to unselfishly serve as a leader, who would help shape the hearts and minds of hundreds upon hundreds of boys to become strong and moral men. For Dad served as Scoutmaster for 28 years! It was only a few months before her passing that my great grandmother shared her prophecy with my father. At 69, soon to turn 70, I know one thing for sure. God cannot be limit ed. The Holy Spirit cannot be limited. I was only five years old, at the time, but I remember it like it was yester day, the profound conviction that Great Grandma Mabey spoke when she told my father he was blessed and destined to be a most positive guid ing force, for many, many boys. Please do keep in close touch with the elders of your family. God grants them a wisdom, a prophecy, that reaches beyond human understand ing. Love knows no boundaries. It cannot be limited. PRECIOUS BE, THY CHERISHED HERITAGE By Richard Mabey Jr.

At 72, I am becoming more and more acutely aware of how blessed my early childhood was. One of the most influen tial people of my early boyhood days was my great grandmother, Dora Mabey. Great Grandma Mabey was an incredible wom an, one of the wisest individuals whom I have ever known in all my life. Born on October 14th of 1873, Great Grandma was the husband of William Mabey Jr., who was born on October 15th of 1868. They were married on June 27th of 1889. Great Grandma gave birth to six children. She had four daughters (Myrtle, Alberta, Mereata and Edna) and two sons (Watson and Earl). Edna died, when she was just an infant. Her son, Earl, was killed in action, in France, during World War I. Great Grandma’s son, Watson, was my grandfather. When they were first married, my great grandparents lived with Great Grandpa Mabey’s parents, William and Catherine Mabey. They lived atop Hook Mountain, in Beavertown (as Lincoln Park was known then) near the Towaco border. They were newlyweds, when they se cured an area of land that ran from Route 202 to the path of the old Morris Canal, around 12 acres in size. Together, they built the old Mabey Homestead, lo cated at the corner of Route 202 and Mabey Lane. The home was completed around 1890. Great Grandpa Mabey suf fered from a stroke and passed away in 1936, at the age of 67.

I would spend the day, visiting at the old Mabey Homestead. Great Grandma Mabey would sit on the front porch, swaying back and forth in her old rock ing chair, snapping green beans or knitting or peeling apples, as I sat on the floor, at her feet, playing with an old set of Lin coln Logs. Great Grandma Mabey would tell me such a wonderful, heart moving, tender stories of her days as a young girl and then of her days as a young pioneer woman. I remember that when ever she would talk of her son, Earl, she would just cry and cry and cry. My heart would be deeply moved and I would get up from the floor and hug my dear, beloved great grand mother. I was just a little boy, but even then I knew that Great Grandma Mabey still deeply mourned losing her son, from the horrors of war. It’s only in the past year or so, that I have developed an even greater appreciation for my dear, sweet Great Grand ma Mabey. She probably didn’t know it at the time, but she was planting the seeds of the ele ments of good story telling into the heart, mind and soul of her great grandson. I don’t think a day goes by that I don’t think about my beloved ancestors. I loved them all so dearly and still miss each and every one of them. I was taught my family heritage, from a very early age. Something that I dear ly cherish. If you’ve reached an age where

Great Grandma Mabey then continued to live in the old Mabey Homestead with her daughter, Alberta (Mabey) Sly. Great Aunt Alberta and her hus band, Edward Sly and their son Leroy, lived with Great Grandma till she passed away in 1959. Great Grandma Mabey was my living connection to my pioneer heri tage. I was a shy, sensitive child. Just about every Saturday, Mom, Dad and

WHAT YOU SHOULD KNOW AFTER BEING INVOLVED IN A CAR ACCIDENT? By John Bazzurro In my practice, clients will typically come in for a consultation concerning injuries sustained in a motor vehicle accident more than one month after the accident has occurred. In general, it is after this time that people realize that they have sustained personal injuries,which warrant a visit to an attorney for advice. However, what a person does or does not do in the first 30 days after a motor vehicle accident may have a significant impact on their ability to bring a lawsuit in the future. First and foremost, it is important that individuals involved in motor vehicle accidents report their accident to the local police or proper authorities to ensure that there is a record of the accident and to obtain the other drivers’ information. In fact, N.J.S.A 39:4-130 specifically requires that any motor vehicle accident in which a person is injured or in which the property damage is greater than $500.00 be reported to the local police department. Often times clients will tell me that they and the other driver decided not to report the accident to the police in order to avoid having to “put it through” their insurance. In these instances, the other driver may attempt to deny that the accident even occurred. Thus it is important that the accident be reported promptly-especially where significant property damage or personal injuries are involved. Second, it is important to know that any and all medical treatment that is required as a result of injuries sustained in a car accident be paid for by the applicable motor vehicle insurance policy as opposed to a health insurance policy. New Jersey law provides that automobile policies of insurance provide Personal Injury Protection coverage (PIP) to allow for those injured in motor vehicle accidents to receive proper medical treatment. If such medical bills are paid for by health insurance as opposed to automobile insurance, issues may arise in the future concerning the potential need to repay the health insurance company for any benefits paid. Thus, when visiting an emergency room or physician for treatment related to a car accident, you should provide them with your automobile insurance policy information. Third, with regard to damages to your vehicle, you should obtain a copy of the police report as soon as possible (typically police departments will be able to provide same within a few days) for purposes of identifying the other drivers’ insurance company. Once the insurance company is identified, they should be contacted and advised that your vehicle sustained damage due to the negligence of their driver. However, when speaking to the other insurance company, no statements should be given concerning how the accident occurred or the nature and extent of any injuries suffered. Instead, you should only provide them with a copy of the police report to show them how the accident happened. If you provide the other insurance company with a statement, that statement may be used against you in any future litigation (including traffic court) concerning the accident. Finally, any and all “evidence” should be recorded and maintained in the event a lawsuit arises. For instance, photographs should immediately be taken of the damage to your vehicle as well as the other vehicle if possible. Additionally, photographs of any injuries sustained (bruises, cuts, scrapes, abrasions, casts and bandages) should also be taken. If anyone approaches you at the scene of the accident you should take down their contact information for potential future use. If you are aware of these issues and comply with the actions suggested, it will make it easier for you and your attorney to properly and efficiently pursue any claims against the other drivers. However, your failure to abide by all or some of the suggestions, your failure to do so may make any claims much more difficult to pursue. TIPS FOR COMMUNICATING WITH A NONVERBAL CHILD

• Help your child maintain eye contact by putting stickers on your forehead • Give your child the time and space to talk by pausing and looking at them directly • Find times when you and your child are not hungry, tired, grumpy or stressed as these feel ings can translate through body language It’s important to note that chil dren who are nonverbal often become very good at reading body language and faces. They may tense up if they see that you are frowning and withdraw if they feel anger or frustration from you or from others. These situations cause added stress

Helping your nonverbal child find their voice can be both frus trating and incredibly reward ing. Constant encouragement, therapy and attempts to break through their walls may be re peatedly met with failure, only to discover that one day some thing clicks. That single moment can be worth all of the time and dedication you will devote to communicating with your non verbal child. Even if your child is above the age of four and still not communicating with you on a regular basis, it is highly like ly that your child will eventually develop language skills in the fu ture. Here are some tips aimed at helping you communicate with your nonverbal child.

when they don’t need it, so try to be sensitive to finding the “perfect storm” of time, space and positive energy to help your child gain verbal skills. Take Cues from Your Child As a parent, we often feel that it’s our job to lead our children down a partic ular path. While that is often the case, with nonverbal children you will find that you need to vastly expand your ability to listen to their body language. Even eye contact or looking at a particular toy or food can give your insight into their thoughts and desires, and when you observe carefully you may catch small repetitive movements that are the beginnings of a shared language. Re flecting these cues back to your child reinforces them and allows you to slowly build the infrastructure of a conversation with your child. Use single words to help describe what they are doing. For instance, if they are playing with a particular stuffed animal, name it. Be sure you always use the same name with items as consistency is critical or you risk adding to their confusion. Leverage Technology Tools There are hundreds of assistive technology tools that will help aid your communication with your child. These include everything from flashcards with pictures of everyday household items and favorite toys to tablet and smartphone apps that will speak the name of an image that your child taps. While these may work best for older children, even babies and toddlers are often intrigued by the sounds and moving pictures on electronic devices. You may find that your child is willing to interact longer with devices than with humans, so you may need to limit their time on electronics if you see them becoming overly attached. Helping your nonverbal child communicate requires patience, consisten cy and a whole lot of loving care — and a big dash of fun! Get Creative Spoken words are just one way to communicate. Other options include sign language, picture exchange, gestures, pointing, and electronic devices. Some kids gravitate to one method. Others don’t seem interested, no matter what you try. If that’s the case, try everything and stick with it. Repetition is incredibly powerful. Even if your child doesn’t show that he’s paying atten tion or taking it in, you might be surprised to find he knows more than you think. Kids who are shy sometimes feel more comfortable babbling to a pet than a person. Encourage that. Any vocalization is progress! Play is Therapy; Therapy is Play When you have a child with verbal difficulties, every moment is an op portunity for learning and introducing new concepts to your child. Play therapy has long been used as a means of helping nonverbal children find their words by providing a way to integrate socially, develop emotionally and resolve any trauma that may have caused speech development to lag. Psychology Today notes that play therapy is used to help children up to age 12 explore their lives in a safe, comfortable area with a limited number of imposed guidelines or limits. This allows for free expression while parents or therapists observe their activity for cues to help children express them selves in a way that feels more comfortable. The blurring line between play and therapy helps parents expand their observation time beyond the ther apist’s office while utilizing a creative mix of dancing, storytelling, arts and crafts and music. Make Your Child Comfortable People, in general, are more likely to share their thoughts and feelings verbally when they feel comfortable with their audience and their environ ment. You can help your child’s comfort level in a variety of ways: • Get down on their level, such as sitting on the floor
