BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. I Remember Dad: FOND MEMORIES OF THE APPALACHIAN TRAIL By Richard Mabey Jr.
My father firmly believed that when a boy hiked in the woods, for four or five days, he could not help but come to a greater under standing that God really does ex ist. That there is a Wisdom guiding the universe, that is much greater than that of the smartest person on earth. My father would often cite the example of God’s infinite wisdom, in that trees absorb car bon dioxide and release oxygen. Thus, providing us with an essen tial element of life. In the midst of Autumn, I re member there was always some thing called “The Teachers’ Con vention” that would be a time when there would be no school. It was usually on a Wednesday, Thursday and Friday. It was during “The Teacher’s Convention” that Dad would schedule a four or five day sojourn of the Appalachian Trail for Boy Scout Troop 170.

Plus, the weight of your canteen pulls down upon one of your shoulders. It re ally is not an easy undertaking at all. I was very studious in high school and would regularly make the honor roll. My application for Eagle Scout was now at the Na tional Boy Scout Headquarters in New Brunswick. It was now just a matter of being processed, before being able to be presented with the coveted rank of Eagle Scout. Just about every week, I wrote an article for the old Lincoln Park Herald. It was somewhere in Eastern Pennsylvania, along the Appala

chian Trail, that Dad decided it was time for all the scouts to take a break for lunch. Dad and I sat on this big boulder and ate our peanut butter and jelly sandwiches. Mr. Crooks was a bit of a distance from us, eating lunch with his son. The other scouts had all found logs, fallen trees, and boulders to sit upon to eat their lunches. A kind of comfortable silence fell between my father and I as we at our sandwiches. I remember that Dad looked down upon the earth, looked out to see all the boys happily eating their lunches, taking sips of water from their can teens. Then Dad looked out to the horizon. “I’m proud of you son. You know your life’s gonna be a lot different when you start college. Your studies are going to take a lot of your time. This might well be the last big hike we take together,” Dad said as he looked into the horizon, then took a momentary look into my eyes. “You’ll do well, I know you will,” Dad said to me in a rather quiet voice. “Thanks Dad,” I said to my father. “I’ll do my best.” “I know you will son,” Dad replied. A silence fell between Dad and I for a few moments in time. “Well, we better get these boys moving. We’ve got ground to cover,” Dad said to me. I called the boys together. Most of the scouts had finished eating their sandwiches. And once again we all began the fun, the adventure, the en chanted wonder of hiking the old Appalachian Trail. We would start in upper New York State and usually end our hike of the AT in Fayetteville, Pennsylvania, along Route 30, which is also known as the Lincoln Highway. It would be a time of contemplation, of enjoying conver sations with friends, of learning the hard lessons of self-reliance, and also of learning the importance of water. For me, it was a golden opportunity to know my dad a little better. We would hike beneath the golden yellow, the rusty red, and burnt orange leaves of the elm, the oak and the maple, for miles and miles and miles. The sun would glisten between the tree branches. The wind would create a gentle breeze. Squirrels would rustle the branch endings of trees. From time to time, a group of deer would be seen by a stream. And, we were always mindful of keeping an eye out for snakes. In the Late Autumn of 1970, I was in my senior year of high school. That year, only one other scout leader was able to go on the long walk in the woods. Mr. Thomas Crooks was Troop 170’s newest Committeeman. He was not an experienced hiker. His son, Tommy Jr., had also just joined Troop 170. I remember that about a week before we went on the hike, Dad and I were working on a project at my father’s basement workbench. Dad simply said to me, “Richie, I’m glad that you’re going on this hike with us. I’ll be leaning on you a lot.” I still cherish the remembrance of those words that my dad sincerely said to me. When you hike the Appalachian Trail, everything you need for your hike is on your back, inside your framed backpack. Although your sleeping bag

THANK YOU GRANDMA KEMMERER By Richard Mabey Jr.
My maternal grand mother, Lydia Capwell Kemmerer, was born on the ninth of June of 1892. She was the daughter of Rexford and Catherine Tinklepaugh Kemmerer. Grandma was the young est of 11 children. She grew up on her parents’ farm in the small village of Sugar Run, Pennsylva nia. Grandma was a con stant source of inspira tion and encouragement to me. Especially in my writing. In early January of 1966, when I was 12 years old and in the sev enth grade, I found my self in the Barnert Hos pital in Paterson, fighting off a severe case of Rheu matic Fever. I had spent Christmas Day in the hospital.
After Grandma and Grandpa left the hospital, I immediately rewrote my article, adding what it was like to run high atop Ric A-Bear Mountain, pull ing a dog sled with seven other scouts. I knew what it was like firsthand, for I had participated in the big Klondike Derby a year ago, when I was 11 years old. Grandma was right, adding the adventure of running along the ridge of Ric-A-Bear Mountain did add a pinch of salt to my article. From that point on, I would always make it a point to have Grandma K read my articles, be fore typing them up for the old Lincoln Park Her ald. All through my four years at Boonton High School and my two years at County College of Morris, I wrote well over a hundred articles for the old Lincoln Park Her ald. They centered upon scouting events, church youth group happenings and little stories about my neighborhood.
The big Boy Scout Klondike Derby was held on the first week end in January. My dad was Scoutmaster of Boy Scout Troop 170 and had granted me the serious job of writing an article about the Klondike Der by for the old Lincoln Park Herald. I wrote the article from my hospital bed, with the hand-writ ten notes that Dad had written down in his little pocket notebook.
Now at 71, I realize on a much deeper level, how much Grandma K helped me to become a better writer. In the past month or so, I’ve thought a lot about Grandma K. I owe her a debt that I can never repay. In reverent prayer, I thank the good Lord for giving me such a wonderful, loving and caring grandmother, in Grandma K. She had such an amazing insight into human nature. I loved her very dearly, I still do. In August of 1984, the angels called Grandma K, Home to Heaven’s Gate. I don’t think a day has gone by that I haven’t thought of her. Grandma had an immensely kind and loving heart. She made the best apple pies I have ever had. I look forward to seeing her again, at Heaven’s Gate. Richard Mabey Jr. is a freelance writer. He has had two books published. I had just finished writing this article, when Grandma and Grandpa Kem merer came to visit me at the hospital. I showed Grandma and Grandpa my article. They both read it. Grandpa told me he liked it a lot. But it was Grandma who spoke up and told me that something was missing. That my article needed that “little sprinkling of salt” as I remember she called it. “Don’t they have a big mountain in that Boy Scout Camp,” Grandma asked me. “They sure do, Grandma. It’s part of the Klondike Trail,” I replied. “Well then you write about that mountain in your article,” Grandma told me. “It’ll bring a little zest to it,” I remember all so well, Grandma telling me.

As I write the words for this essay, I have become more and more acutely aware of my phys ical failing. For it was only two years ago, that I walked and cared for over a dozen wonderful dogs in my little community. It was common for me, to walk five or six miles a day, walking my fur lined friends, while their mom mies and daddies were away vis iting their adult children. Now, when I walk around the block, I become all so winded, the chest pains prevail. I am becoming more and more aware that it’s the ninth inning, the last scene of Act III of the play. I have been blessed beyond my wildest imagination. My father once told me that God had giv en me a very precious gift, to put words down on paper. He told me that it was my job to develop it, to hone it, to fine tune it. I truly hope that I have not let my father down. When I was two years old, my father built a lit tle desk for me. Dad built a chalkboard onto it. My mother once told me that when I was just two years old, as she would cook supper, I would write down stories on my little desk, drawing stick fig ures. I never chose to be a writer; God chose for me to be a writer. I have no doubt about that. There are too many people to thank. Without whom, I would be nothing. built. It’s a debt I can only recognize but never repay. In 1977, in a small town in West Virginia, I attempted to be a successful chiropractor. But I failed miserably. I was dirt poor, had only four or five patients, wasn’t eating right and living in tight quarters of a back room of a store front office. The strep throat came and once again, I came down with Rheumatic Fever. Returning to the old farmhouse on Mabey Lane, I fell into a deep, deep sleep. And in that deep sleep, I felt the unmistakable spiritual presence of Thomas Wolfe. And the endearing Southern gentleman, simply whispered to me, “write the stories of these people, whom you love so much.” To all of my dear and precious readers, I share these heart-felt words. Do not ever let anyone kill your dreams. Walk away from your harsh critics. Believe in yourself. Dig deep to find your purpose upon this Earth. Always give it 110 percent. Nev er, ever give up. STAY OFF YOUR CELL PHONES! By John Bazzurro
A recent change in New Jersey Motor Vehicle Law has prompted me to write this article and advise the public of the potential pitfalls of talking on a cell phone or operating an electronic device while operating a motor vehicle within our state. The relevant statute, N.J.S.A. 39:4–97.3 has been amended by our Legislature to increase the fines associated with such an offense and, further, provide the Municipal Court with discretion to suspend driving privileges for a period of up to 90 days for a third or subsequent offense. Further, the revised statute now provides that a third or subsequent offense will also include the imposition of three motor vehicle points. While the suspension of driving privileges and three motor vehicle points are significant for a three or more time of violator, the increase in fines are also rather significant even for a first offender. The statute provides that the fine shall be between $200.00 and $400.00 for a first offender; between $400.00 and $600.00 for a second offender; and between $600.00 and $800.00 for a third or subsequent offense. These penalties have been significantly increased as a result of the change of this statute. It should be noted that talking on a wireless telephone or using an “electronic communication device” by the operator of a moving vehicle on a public road or highway is a violation of the statute. This would include utilizing a smart phone for texting, emails, Internet browsing, etc. Using a “hands-free” device does not violate the statute as long as the placement of the device does not interfere with the operation of the motor vehicle or any equipment within the motor vehicle. Interestingly, an “amateur radio” is not an “electronic communication device” under the statute. Finally, you should be aware that you may use a handheld wireless device while operating a motor vehicle as long as one hand is on the steering wheel if you are contacting emergency personnel where you feel that a criminal act is being perpetrated or you are reporting a hazardous road situation. In this instance, however, you will be required to provide cell phone records to establish that the phone call you were on was, in fact being made to emergency personnel. In conclusion, it would not only be wise to stay off of your cell phone while operating a motor vehicle because of the penalties described above, but also due to fact that utilizing a cell phone, including texting or looking at emails, etc. while operating a motor vehicle could put your life and the lives of others in jeopardy. Timmy’s Story: A SENSORY FRIENDLY BIRTHDAY By, Pam Teel Young Author Tim Rohrer, who has overcome many obstacles in his life due to his autism, is set to release his second children’s book. The book is a sequel to his first book, Timmy’s Story: A Story About Autism and Friendship . His first book, focuses on inclusion, and is based on his own past life experiences. His second book, Timmy’s Story: A Sensory Friendly Birthday, also is a reflection of his past, and teaches one about autism through the eyes of someone who lived it. For those with autism, sensory sensitivities may make birthday parties difficult to enjoy. Tim’s second book tells a true story, with that in mind, about how his teacher and his classmates made his birthday party one that he could enjoy. Tim’s brother Daniel, who is a senior at Allentown High School, is doing his senior practicum helping behind the scenes of “Tips4Inclusion.” He did the book editing for his brother. Tim has not only become an author but a speaker, self-advocate, and educator of disabilities. He has been asked to speak at schools, conferences, and has also received a commendation from the NJ State Senate and Assemblymen. He is also a managing partner of a teen founded nonprof it organization called 5Help Foundation.
