DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. REMEMBERING MY DAYS AS QUARTERMASTER By Richard Mabey Jr.

In February of 1967, I was 13 years old and in the eighth grade at dear old Chapel Hill School. It was at that time that a most wonderful and honorable title was be stowed upon me by the Troop Committee of Boy Scout Troop 170. That honor was becoming a Warrant Officer, in the role of Troop Quarter master. A job that I took very seriously. The role of the Troop Quartermaster was mul tifaceted. As Quarter master, I was in charge of keeping an inventory of all the troop’s tents, cooking gear and equip ment. It was my job to be the leader for tent repair Saturdays that we used to have twice a year in the backyard at the old Mabey Homestead. And it was my job to make sure that all the tent poles were in working condition. And, that ev ery tent had enough tent stakes in each tent’s little stake pouch. But the truth of the matter is, that at the time,

ter was not the most grand and glorious position, but it was the very place where God planned me to be, to grow and learn, to become a good leader. In September of 1969, as I began my junior year at Boonton High School, I became Boy Scout Troop 170’s newest Senior Patrol Leader. I soon learned it wasn’t all glory, but rather a lot of hard work. Leadership is not easy. I can honestly say that I did a fairly good job in my role as Senior Patrol Leader. But paramount to it all, I would have never really been ready for the job of being the Senior Patrol Leader, if I had not grown and learned all so very much that I did in my role as Troop Quartermaster for two years. Sometimes, God puts us in a position that doesn’t quite match where we want to be at the time. We dream of greater heights. But God, in His infinite wisdom, knows the best place for us to be, in order to learn and grow to prepare for the next higher step in life. Richard Mabey Jr. is a freelance writer. I wasn’t completely happy to be the Troop Quartermaster. Deep inside my heart, I really wanted to be the Senior Patrol Leader. That was the seemingly glorious position. It was the Senior Patrol Leader who got to run each scout meeting. It was the Senior Patrol Leader who would lead Troop 170 in the big annual Lin coln Park Memorial Day Parade. And, it was the Senior Patrol Leader who would represent the troop at the Saturday evening Commissioner’s Round Table Meeting at both the big District Spring Camporee and the Fall Camp oree. I didn’t realize it at the time, but God had put me in the right position to be the Troop Quartermaster. I learned all so much, in my two years serving as Quartermaster. I kept detailed inventory records of the troop equipment. I led the scouts in the Saturday tent repair days. I kept our troop closet, at Thorpe Hall at Saint Andrew’s Episcopal Church, in immaculate condi tion. I learned to be very organized and to present equipment status reports at some of the Troop Committee Meetings. Being the Troop Quartermas

One of the dearest and most precious memories of my childhood, is that Grandma and Grandpa Mabey lived with us in the old Mabey Homestead in Lincoln Park. As you looked at the old farmhouse, my bedroom was on the right-hand side, looking out to West Drive on the side. Grandma and Grandpa’s bedroom was right behind my bedroom. I was eight years old, during the Summer of 1962, and had just complet ed the third grade at dear old Chapel Hill School. I remember how much Grandpa loved to take a morning walk down Mabey Lane and then follow the forest path to the banks of the old Morris Canal. For it was there that that Grandpa worked with his father, when he was a boy, at the old Mabey Icehouse. As a boy, I often walked that wooded path with my grandfather, Watson Mabey. Grandpa would hold my hand. As we walked among the maple and the elm and the oak, Grandpa would tell me about the “Majestic Buck” who walked the forest acres, along the length and breadth of the old Morris Ca nal. Grandpa would tell me that any man who looked the Majestic Buck, square in the eye, was a marked man, destined to be given a gift from the Divine Spirit of God. It was during one of the walks, along the wooded trail, that Grandpa and I saw the Majestic Buck, standing tall and proud, just a few yards from us. I was eight years old at the time. What was about to transpire would leave an indelible mark upon my heart, mind and inner being. The Majestic Buck began to walk toward Grandpa and I. Grandpa stood still and told me to do the same.

Then this frightening, immensely proud and self-assured wild creature looked me straight in the eye. I remember inwardly shuttering. The Majestic Buck then threw his head back once again, as if to say good bye to Grandpa and I. I remember the proud deer then turned about and tot ted off into the distant forest. Grandpa simply said to me, “Dicky Jim, you’re a marked man.” I remember Grandpa’s voice was soft and reverent and solemn. For in that moment in time, something stirred within the deepest chambers of my heart.

DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances.
