DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. THE BLESSING OF LITTLE ROCCO By Richard Mabey Jr.
This past March, when my neighbor Martha was rushed to the hospital by ambulance, Little Rocco was left behind in her bathroom. Martha is in her early 80’s. She lives alone. My sister Patti and I kind of look after her, without being over bearing. When I saw the ambulance drive by my house, some thing inside me told me that it was for Martha. It was an instinctive knowingness. And, sure enough, the ambulance did stop in front of Martha’s house. Sadly, Martha was hav ing a heart attack.
little pooch. It was during that time, that I was working with a lo cal printer to get my book of poems and short stories published. I would take Little Rocco to the printer with me. They all loved him. It was a most wonderful and enchant ing little period of time. Some time in the midst of Little Rocco’s stay with me, a shift occurred. I no longer be came Little Rocco’s care giver, but rather evolved to become his friend. We developed a bond of good will, respect and love for each other. When Martha came home from the hospital, she offered me money for taking care of Little Rocco. It seemed wrong to take money for caring for Little Rocco. So, I kindly re fused Martha’s offer to pay me. It was truly a labor of love. For another month or so, I

In what seemed to be a blink of an eye, Martha was carried out, in a stretcher, to the back of the ambulance. Martha was still conscious, but the mark of severe chest pains grimaced her face.

walked Little Rocco three to five times a day, as Martha recovered from her hospital stay. Eventually, the doctor gave Martha the green light to walk Lit tle Rocco, but only up and down our block. Little Rocco changed my life. At the time, I was seriously considering the idea of giving up on writing. I really was. But the love that Little Rocco brought to my life, gave me the inspiration to once again pick up a pencil and write words down on paper. I confess that I am still a bit old school, and do my first draft of a story the old fashioned way, of writing with a pencil and paper. Here’s the whole bottom line. It is impossible to give kindness to another person, without receiving back goodness and mercy many times over. Even if you help another person, and they seem rather ungrateful, your reward will come unto you from another person, another source. It’s uncanny how it works. Not that we should do kind acts for one another and then be look ing for rewards. Not at all. But the virtues of kindness, goodness, compas sion and mercy, have a way to come back unto us when we give them out to others. None of us have a guarantee that we will see the sun tomorrow morning. Forgive others the wrongs they have done unto you. Love one another. Be kind to animals. Help those in need of help. For God will then greatly bless you. Richard Mabey Jr. is a freelance writer. As the paramedics passed by me, in one split second, Martha whispered to me, “Richard, please take care of Little Rocco, he’s in my bathroom.” I promised Martha I would. Our conversation took place in all of about three to five seconds. As the ambulance sped off, a solemn silence filled the air, within the half dozen neighbors that had clustered around Martha’s front yard. Tom, an elderly gentleman, looked me in the eye and simply said, “if you need help taking care of Little Rocco, let me know.” I told him I would. I walked into Martha’s house. One of Martha’s next door neighbor’s had a key to her house, to lock up for after when I had taken Little Rocco. The sweet little Yorkshire Terrier shook as I held him in my arms. I walked down my street, carrying Little Rocco, with his lead in my pants pocket. Martha was in the hospital for a little over two weeks. She was treated for angina, as the doctors debated if she would need to have heart surgery. For tunately, Martha did not need heart surgery. However, she was treated for angina. For those two weeks, Little Rocco stayed with me. I had one of those dog crate cages. Rocco slept in it nights, so that he would be undisturbed by my two cats, Opie and Floyd. Amazingly, Opie and Floyd actually took a liking to Little Rocco. In my little backyard, I would play fetch with Little Rocco. We went for walks around the neighborhood, about five times a day. I quickly discovered that Little Rocco was the toast of the neighborhood. Everyone just loved the

MANGO CUCUMBER SOUP
Sweet, ripe mangoes are the basis for this refreshing and quick chilled summer soup. It’s a no-stove recipe that’s perfect when outdoor tem peratures rise. Makes 4 servings Ingredients 2 ripe mangoes (divided) 1 English cucumber (divided) 2 tablespoons chopped onion 1 jalapeño pepper, finely diced (optional)
1 lime, juiced 1/2 cup water 2 -6 oz. containers plain, non-fat Greek yogurt 1/4 cup fresh chopped cilantro Directions 1. Cut all but one half of mango into chunks, removing peel and pit; chill remaining mango half for use with garnish. 2. Slice off 1/4 of the cucumber and chill for use with garnish. Coarsely chop remaining 3/4 of the cucumber.
3. Place chopped mango, cucumber, onion, and pepper (optional) in blender or food processor with lime juice and water. Purée until smooth. 4. Blend in yogurt. Chill until ready to serve. 5. About 15-30 minutes before serving, prepare garnish. Dice chilled man go half, removing peel and pit; dice remaining cucumber. Mix mango and cucumber dices with cilantro. To serve, top bowls of soup with garnish.

DO YOU HAVE UMBRELLA COVERAGE ? By John Bazzurro Over the past several weeks, I have had two unfortunate situations that have arose in my prac tice that have prompted me to write this article concerning something called “umbrella coverage.” Despite its name, this type of insurance coverage has nothing to do with protection from weather events. As will be seen below, “umbrella coverage” is another layer of insurance coverage that is rec ommended in order to properly protect you and your family against judgments and lawsuits arising out of your negligence or the negligence of a family member within your household. In one case, my client was significantly injured in a motor vehicle accident with a 17-year-old boy who had only recently received his drivers’ license. The automobile insurance policy on the young man’s vehicle had policy limits of $250,000.00 for the benefit of parties injured as a result of the negligent operation of the vehicle. The young man and his family live in a large home in an upper class Township within Monmouth County and, as such, it would seem that he and his family would have a reason to protect their assets over and above the $250,000.00 policy limits of their automo bile insurance. Unfortunately, they did not have additional insurance coverage and, as such, given the significant nature of my client’s injuries, their personal assets could now be in jeopardy in the litigation. In another case, a client of mine caused a significant accident in which a number of people were injured. Although I only represented her on the traffic tickets she received, both her and her hus band inquired as to whether or not it was likely that they were going to be sued for personal injuries arising out of the accident. Similar to the family above, my client and her husband only had automo bile insurance with $300,000.00 in policy limits to cover the injuries sustained by the other individ uals involved in the accident. The client’s husband was a medical professional and, once again, had significant assets over and above the $300,000.00 policy limits which he and his wife should have protected. When I asked them if they had “umbrella coverage” to further protect them, they did not know what it was. At a minimum, if you own a home and an automobile, you should have an automobile insurance policy that protects you against injuries you cause in a motor vehicle accident as well as homeowners’ insurance which protects you against injuries caused by you and your resident family members for negligent acts (other than an automobile accident) that cause injuries to others. All homeowners’ insurance policies contain an “automobile exclusion” for which the homeowners’ policy will not cover injuries to others as result of the operation of an automobile. If either of these policy limits are insufficient to “pay for” the injured parties’ injuries, “umbrella coverage” is intended to supplement your policy limits. Typically, “umbrella coverage” is purchased to supplement the above referenced automobile insurance policy limits and homeowners’ coverage policy limits; often at a reasonable rate. Such “umbrella coverage” is utilized and necessary to protect assets when your assets are greater than the policy limits afforded by either your homeowners’ policy or motor vehicle policy. Unlike homeown ers’ coverage, “umbrella coverage” does not contain an “automobile exclusion” and, as such, would be available to supplement automobile insurance coverage in the two scenarios described above. Accordingly, while it is a good idea to review your insurance coverages on a regular basis with a qualified insurance agent or broker, you should always be cognizant of the amount of your automo bile coverage and homeowners’ coverage in relation to the amount of assets you intend to protect. Importantly, regardless of the amount of assets you presently have, a judgment against you arising out of your negligent acts may last for 20 years or more and, therefore, assets which you accrue in the future may also be in jeopardy. ARE MY KIDS WATCHING TOO MUCH TV? By Brianna Siciliano Television is a great source of learning and entertainment for children, but too much television may not be healthy. The American Academy of Pediatrics recommends that children under the age of 2 do not watch television, and that children around the ages 2 through 6 only watch one to two hours of television a day. Is this realistic? Yes. Do most families fol low this recommendation? Probably not. Media sources are everywhere today. No matter where you are, you most likely have a television, tablet, or smart phone handy, and with those sources of electricity come games, videos, and more. Past generations grew up without all of these media sources, keeping busy with building blocks and their imaginations, and they turned out fine. Limiting television time is not a terrible course of action to take. In some cases, limiting the television shows your child watches is a better solution than limiting the time your son or daughter watches TV. While there are television shows that represent great messages like shar ing with others and learning educational lessons in a fun way, there are also dangerous shows that promote fighting and violence. Research shows that children who are entertained by violence and fighting become desen sitized over time, causing them to brush off the seriousness of bullying. Other outcomes of watching violence are increased anxiety, fear, aggres sive behavior, sleep deprivation, and attention and academic problems. If your child is using his or her limited television time to watch violent shows, than there is no benefit of limiting his or her TV time. Instead, it might be best for you to add child blocks to your television and make it impossible for young ones to watch harmful shows. To Thine Own Self Be True: BE IT MORE PRECIOUS THAN GOLD By Richard Mabey Jr.
At the dawn of the Summer of 1963, I was nine years old and had just completed the fourth grade. Summer was a most magical time for me during my childhood. Be hind the old Mabey Homestead, at the end of Mabey Lane, acres and acres of wooded land abounded. Grandpa Mabey and I would of ten walk the path from the end of Mabey Lane to the path along the old Morris Canal. I learned ever so much from my paternal grandfa ther, Watson Mabey. Grandma and Grandpa Mabey lived with us in the old Mabey Homestead. As you looked at the old farmhouse, that my great grandfather built in 1890, my bedroom was on the right-hand side and faced along West Drive. Grandma and Grandpa’s bedroom was right behind mine and faced along West Drive and our old backyard. I remember Mom would cook breakfast for us. After breakfast, Grandpa would often ask me if I wanted to take a walk with him, down to the old canal banks. I would happily say yes to dear old Grandpa. We would walk down to the end of Mabey Lane. Grand pa would always take a reverent and earnest moment to look at the home, that stood at the end of Mabey Lane, that he had built when he was just a young man. Then we would walk the wood
to care for the wild birds that fly among the trees. I now live in Northwest Oca la, having recently moved from The Villages in Florida. A certain ache has loomed in my heart, of missing the many dogs of my old neighborhood to whom I once walked and cared for when their mommy and daddies went away to visit their adult children. But I could feel the call of a new mission in life, an awakened purpose. And, that was to fulfill the gentle whis pering call of Grandpa’s nightly visits, to care for the wild birds that flew among the trees. There are seven Live Oaks on the property of my new home. They are magnificent trees, strong and towering tall. In the past couple of weeks, I have begun buying in expensive bird feeders. I fill them with wild bird seed, climb my lad der and hang tie them with strong string to the branches of my Live Oaks. My little yard, both the front and back yards have now become a wonderful, magical, open-aired aviary. The melodies of the chirp ing of birds are a most beautiful sound. In just a very short peri od of time, when I am doing yard work in my front yard, people in the neighborhood will comment that my yard has a cheerful feel ing. I simply tell them that it’s all because of the birds singing and

ed path to the towpath of the old Morris Canal. Along our walk, Grandpa would point out what wild plants were edible and which ones were poison ous. We would often see a group of deer, feasting on the leaves of the ma ple and oak. And Grandpa would point out the birds brightly chirping and clinging high upon the branches of trees. Grandpa knew all so very much about the ways of the wildlife, the sacred secrets of the enchanted forest. Lately, I have felt, all so strongly, the presence of dear old Grandpa Mabey. I often wake up in the middle of the night and see Grandpa sitting at my desk chair. His crooked smile, his large hands, his kind eyes look upon me as I swim in a place between sleep and awakened consciousness. And one message of late, I can hear Grandpa whisper to me, in his nightly visits is
flying about. In taking the time to refill my many new bird feeders that I have placed throughout my yard, I have found a new purpose in life. It may sound like a small thing. It may seem all so insignificant. But it has all brought a certain joy and happiness to my life. For it really is true, to thine own self, be true. A MOST ENDEARING LESSON By Richard Mabey Jr.
I was recently diagnosed with a severe case of Hypertrophic Car diomyopathy. It’s two big words for a heart condition in which the walls of the heart ventricles become very thick. So much so, that they actu ally decrease the size of the sacs of the heart ventricles. There is really no cure for this heart disease. A few days after my heart cathe terization, that was the final heart procedure to verify my Cardiol ogist’s diagnosis, I went to a big comic book show. I confess that I love comic books. One of my re grets in life is that I never got to meet the late, great Stan Lee. But, that’s life. At any rate, a moment in time at the big comic book show, deeply touched my heart. It was as if the odds were a million to one, that I was at the right place, at the right time, for God to teach me a most valuable and endearing life lesson. I was looking through the boxes of old Spider-Man comic books, when this cherished moment un folded. A few feet away from me, were what appeared to be, a father and son. The dad seemed to be late middle age. The son appeared to be somewhere in his early twenties. Like me, they were looking for old Spider-Man comic books. Within a few moments, it became apparent that the young man, the son, was autistic. I write of this observation, with utmost earnest respect. I could not help but to overhear that the young man was looking for
Spider-Man and all his villains. We talked for a good 10 minutes or so. Then the father simply said that it was time for his son and him to get back to the task of finding more good Spider-Man back issues. We all shook hands and returned to searching through boxes of comic books. Upon leaving the big comic book show, the memory of that meeting with my two fellow Spider-Man fans, haunted the marrow of my bones. The incredible joy and hap piness that the son displayed, when I handed him the old Green Goblin comic book, had touched a chord in my heart. I confess that I was feeling just a bit sad when I first entered the doorway to the big comic book show. As I drove home, it dawned on me that God had brought the father and son team into my life, if even for just a few minutes, to bring a certain joy to my heart. There are really no words to convey the immense happiness that the old Green Goblin comic book brought to the heart of that fine young man. He actually jumped up and down a bit, when he first held the comic book in his hand.
The young man’s joy and exu berance over a seemingly simple thing, awoken me to realize that I needed to rise above my sadness. After pulling into my garage, I took a walk around my yard. Birds were basking in my two front yard birdbaths. The yellow flowers in my flowering bush were abounding. Birds sang and flew about my old Live Oak. A neighbor walked by, walking his dog, and we exchanged friend ly waves and greetings. The joyful young man at the comic book show, gave me the gift of a most valuable lesson. To find the joy, the happiness, the splendor in the seemingly simple things in life. More than likely, I will never see that wonderful father and son team ever again. As I was looking through my box of comic books, I came across a rather rare Green Goblin tale that seemed to be priced, very reasonably. I most respectfully, with the Spider-Man comic book with Green Goblin on the cover, asked the father and son team if they had this particular comic book. I explained that I could not but help overhear their enthusiastic search for Green Goblin comics. The young man smiled, from ear to ear. He ex claimed that he did not have that issue. The father smiled at me and thanked me for finding that particular Green Goblin comic book. We introduced ourselves to each other. Then got lost in small talk about
