BURN FURIOUS DETERMINATION WITHIN YOUR HEART AND MIND By Richard Mabey Jr.

In early September of 1965, I had just turned 12 years old and start ed the seventh grade at Chapel Hill School in Lincoln Park. I was look ing forward to being in a school setting where the students changed classes, every hour. My social life centered upon the Youth Group at First Reformed Church and Boy Scout Troop 170 of Saint An drew’s Episcopal Church. Little did I know it at the time, but my life sud denly changed that early September when I awoke with a very sore throat. Mom took me to our fam ily doctor. Although well meaning, he didn’t take my sore throat quite as se riously as he should have. Within a few days, my sore throat worsened, and Mom took me back to our family doctor and I was diagnosed with strep throat. Sadly, my strep throat led to full blown Rheumatic Fever. Mom took me to see a wonderful young cardiologist, who had just opened up his medical practice. Dr. Martin Rosenthal immediately had me go to the hospital. This was in early October of 1965. I spent three weeks in the Barnert Hospital, in Paterson. I remember Dad brought me a book that I had just begun reading, simply titled, “Eagle Scout” by Wilfred McCormick. To say I read that book is an understatement. In those three weeks, I read this book, from cover to cover, three or four times, during my stay at Barnert Hospital. For nearly one year of my life, from early October of 1965 till late August of 1966, my feet never touched the ground. I was to have two more long-term hospital stays. I had a very wonderful tutor. I was a very serious student and did well on the tests that my tutor gave me. But my real passion lied in read ing and rereading my favorite book, “Eagle Scout.” I would dream of being an Eagle Scout. During my year of battling Rheumatic Fever, a fury burnt in the deepest chambers of my heart, to one day become an Eagle Scout. In September of 1966, I started the eighth grade and returned to Boy Scout Troop 170. At that time, in the midst of the baby boomers, there were well over 50 boys in Troop 170. I was the most unlikely of all to have the physical strength and endurance to earn the coveted rank of Eagle Scout. I failed the tests for the Swimming Merit Badge three summers in a row. My outlook for

becoming an Eagle Scout looked rather grim. I prayed and prayed ev ery night, for years during my time of being a scout in Troop 170, to become an Eagle Scout. As if the odds were a million to one, a good friend told me about swimming classes at the Paterson YMCA. To make a long story short, I took the swimming classes and became a fairly good swim mer. Enough to earn the Swimming and Lifesaving Merit Badges. The only two merit badges I still needed to earn scouting’s highest rank, that of Eagle Scout. During my struggles of earning the Swimming Merit Badge, I kept a burn ing desire in my heart. I prayed and prayed and prayed for God to bless me with the strength and stamina to earn the Swim

ming Merit Badge. A lion roared in my heart. Flaming determination burned in the sinews and chambers of my heart. Nothing was going to stop me. Failure was not an option. I was not going to give up on my dream to become an Eagle Scout. As a teenage boy, I was thin and shy. But my closest friends knew there was a deep inner strength that surged through my veins. Nothing was going to stop me. Nothing. It was a proud moment for me, when the badge of Eagle Scout was pinned to my scout uniform. If you have a dream, a goal in life, something that is very near and dear to your heart, never, ever give up! Never give up! Fan the flames of determina tion in your heart. Focus with all your inner strength, within the marrow of your bones, to see your dream to come true. Never, ever give up! Don’t let anyone tell you that you can’t reach your goal, that you don’t have the stuff to see your dreams come true. Ignore the naysayers. Walk away from them. Or for that matter, run away from the naysayers. Miracles happen! God will guide you to help you see your dream come true! DO YOU NEED A LAWYER IN MUNICIPAL COURT? BY JOHN BAZZURRO As indicated on our website, there are numerous charges that are heard in the Municipal Courts in the State of New Jersey. These range from low level motor vehicle violations such as going through a stop sign, careless driving, failure to maintain your lane and other charges that generally carry very low fines and two or less motor vehicle points. If you have been charged with any motor vehicle violation that carries more than two motor vehicle points upon a conviction, we suggest that you obtain the advice of counsel before going to court. The purpose of this article is to provide the reader with some information as to whether or not they need legal representation in Municipal Court on a low-level motor vehicle violation that carries two or less motor vehicle points. As most citizens of New Jersey know, municipal prosecutors will, generally, as a matter of course offer a “no point” or “zero point” violation as part of a plea bargain if you are charged with one of these low-level motor vehicle violations. The monetary cost of these “no point” or “zero point” violations are rather excessive in that you are required to pay a $250.00 surcharge for this “privilege.” The statute which provides this “no point” plea is called the unsafe driving statute. The basic theory in accepting a “no point” or “zero point” plea bargain is to potentially avoid motor vehicle points on your license in order to keep your auto insurance premiums lower and, potentially, to avoid the suspension of your driving privileges where you are in danger of accumulating 12 motor vehicle points which will result in a temporary suspension of driving privileges. However, it should be pointed out that there are a number of situations in which your acceptance of such a “no point” or “zero point” plea bargain may adversely affect your rights without your knowledge. One such situation is where you have already previously pled guilty to unsafe driving on more than one occasion. Your third guilty plea to unsafe driving within a certain period of time will subject you to four motor vehicle points when you may be under the mistaken belief that you will not be receiving any motor vehicle points. Another such situation where you potentially will need legal representation is where the low-level motor vehicle violation is the result of a motor vehicle accident. The bottom line is that, regardless of what type of motor vehicle violation you are charged with, you should seek the advice of an attorney before appearing in Municipal Court by yourself and entering into a plea bargain which may subject you to other legal ramifications of which you were not aware. Typically, when we receive a call for a motor vehicle violation, we initially attempt to obtain as much information as possible from the potential client to determine whether or not they will require legal representation given their individual circumstances. It was two and half years ago that I was diagnosed with Hypertrophic Cardiomyopathy. At first, I was devastated. But within a few months, I began to accept my fate, my destiny. Strange as it may seem, it was a little dog named Rocko, who helped me through those early weeks of reaching acceptance of having this horrible heart disease. Rocko’s mommy was a kind lady, who was in her ear ly eighties, who lived on my block when I lived in The Villages. Martie loved Rocko. When the time came that Martie needed to have surgery on her knee, she asked me if I would take care of her cute little puppy. I imme diately agreed. I simply loved Little Rocko.

I had often walked and cared for Little Rocko, for well over two years pre viously. Rocko and I were good pals. While Martie was in the hospital, every morning I would wake up at seven in the morning and walk up to Little Rocko’s home and feed and walk Little Rocko. After walking Rocko a good mile, I would bring Rocko home and play fetch with him on his living room floor. As destiny would have it, Martie needed to reside at a rehabilitation center to receive physical therapy from having her knee operated on. All in all, the time that I cared and walked Little Rocko every day, was well over a month’s time. Needless to say, Little Rocko and I became best pals. Martie had told me, before she went in for her surgery that Little Rocko had a serious heart problem, so she gave me Little Rocko’s Veterinarian’s name and phone number. Martie told me that she had her credit card number on file with Little Rocko’s doctor. She told me if needed, to let Rocko have the best medical care. Fortunately, I did not need to call on Little Rocko’s doctor the whole time I took care of Rocko. Sadly, about a year ago, Little Rocko went to Rainbow Bridge. It was a sad day, to say the least. I cried my eyes out, when I was told of Little Rocko’s passing. I loved him very much. Yesterday, I was putting up outdoor Christmas lights on my house. I was feeling a bit down, remembering the times that my father and I used to put lights up atop the long front porch of the old Mabey Homestead. I felt a heavy, sadness. I was all so dearly missing my beloved father. I was only three steps on my ladder, when I inwardly heard a distinct, high pitched barking of a dog. It was the unmistakable, unique, trademark bark of my dear puppy friend, Little Rocko. When I turned around, from facing the front porch windows of my home in Florida, to looking at my front yard, my heart leaped with joy. There, on my front lawn, I saw the ghost of Little Rocko. As I climbed down the ladder, the specter of Little Rocko began jumping around in circles, as I remember all so well, how he would often do that when he would first see me. There was no mistake about it, a ghost-like Little Rocko was hopping and jumping around, just a few feet from me. As I walked closer to Rocko, he simply vaporized and disappeared. At the same time, joy and sadness filled my heart. Can love be limited? Can God be limited? Is there a connection, that we as human beings, hold with the precious animals in our lives? Is the death of a beloved pet, really and truly the end of a spiritual connection with that dear and special one? Each and every one of us, holds the answers to these questions, hidden deeply in the chambers of our hearts. Truly, love is the most positive powerful force in the universe. Because the nicotine in tobacco is highly addictive, people who quit may experience nicotine withdrawal symptoms, especially if they have smoked or used other tobacco products heavily for many years. Although many of the examples in this fact sheet refer to smoking, the tips are relevant for those who are quitting the use of any tobacco product. Common nicotine withdrawal symptoms include: • nicotine cravings • anger, frustration, and irritability • difficulty concentrating • insomnia • restlessness • anxiety • depression • hunger or increased appetite Other, less common nicotine withdrawal symptoms include headaches, fatigue, dizziness, coughing, mouth ulcers, and constipation. The good news is that there is much you can do to reduce nicotine cravings and manage common withdrawal symptoms. Also, it may help to know that nicotine withdrawal symptoms do subside over time. They are usually worst during the first week after quitting, peaking during the first 3 days. From that point on, the intensi ty of symptoms usually drops over the first month. However, everyone is different, and some people have withdrawal symptoms for several months after quitting. What can I do about nicotine cravings after I quit? People who use tobacco products get used to having a certain level of nic otine in their body. After you quit, cravings develop when your body wants

You may start experiencing cravings with in an hour or two after your last use of tobacco, and you may have them frequently for the next few days or weeks. As time passes, the cravings will get farther apart. However, you may have occasional mild cravings months or years after you quit. Here are some tips for managing cravings: • Try nicotine replacement products or ask your doctor about other medications. • Remind yourself that cravings will pass. • Avoid both cravings and situations that you used to associate with using tobacco products. • As a substitute for smoking, try chewing on carrots, pickles, ap ples, celery, sugarless gum, or hard candy. Keeping your mouth busy may stop the psychological need to smoke. • Try this exercise: Take a deep breath through your nose and blow out slowly through your mouth. Repeat 10 times. I Remember Dad: MY FATHER’S LAST TALK ON SCOUTING By Richard Mabey Jr.

On the sixth of Septem ber of 1997, my beloved father turned 70. The day before, I turned 44. Early September of 1997 brought a very endearing and heart moving moment to my life. For I began to see just how much the words of the Scout Law and the Scout Oath really meant to my dad. Dad had served as Scoutmaster of Boy Scout Troop 170 nearly 30 years, from 1965 till 1994. It was in 1997, that my cousin, Raymond Kem merer served as an Assis tant Scoutmaster of a Boy Scout Troop in a small town in Pennsylvania’s Le high Valley. During the Summer of 1997, my Uncle Pete and Aunt Alice hosted a big family reunion at the Knothe Farm in Randolph, New Jersey. There, Dad and Cousin Raymond became reacquainted and talked and talked about scouting. Before we all went home that day, Cousin Raymond invited Dad to give a talk at his scout troop. So, after a couple of fol low up telephone calls, be

We took a break at about 5:30 or so and walked to a little restaurant in the cen ter of town. There, in that little eatery, Dad confided in me that he was nervous about his upcoming talk. The Court of Honor was to begin at 8:00. So, Dad and I had just enough time to eat our supper, walk the block and a half back to our motel room and then change into our old scout uniforms. To say that my dad knocked the ball out of the park, in giving his talk on scouting, is an under statement. Dad touched and moved the hearts of everyone in that meeting hall, when he gave his talk on what scouting meant to him. I nearly cried. It occurred to me then, just how much my beloved father loved scouting. How his motto of “it’s better to teach a boy the straight and narrow, then to rehabilitate

a wayward man” rang so true that night. My father believed in every single word of the Scout Law and the Scout Oath. He lived it in every aspect of his life. It’s hard to believe that was over 18 years ago, when Dad gave his last talk on what scouting meant to him. I loved my father with all of my heart. I dearly miss him. If there are any words I can share with you, good reader, it’s this. Love the ones dear to your heart. Tell them. Forgive people when they do you wrong. Forgive, forgive, forgive and forgive again. None of us are go ing to live forever on this earth. None of us have a guarantee for tomorrow. Hold dearly this truth, that love is the most powerful force in the universe. We arrived at the motel at about 3:00, on a Friday afternoon. I had taken a day off from my job at the phone company. There was a certain joy in the air. The temperature was beginning to drop, and soon the leaves of the maple, elm and oak would shame an artist’s canvas, with their brilliant colors. As soon as we got settled into our motel room, Dad began reviewing his notes for his speech. I don’t know why I remember this, but I was in the midst of rereading Thomas Wolfe’s novel, “Look Homeward, Angel” for the

By John Bazzurro Obviously, the easy way to avoid being pulled over is to refrain fr om violating any tra ffi c violations. However, in my practice, I have recently seen a number of people pulled over for reasons other than moving violations under the tra ffi c code. Because the fi rst defense for attorneys in representing individuals in municipal court is to challenge whether or not the o ffi cer had appropriate cause under New Jersey law to actually make the stop in the fi rst place, any “legal” reason that an o ffi cer has to e ff ectuate a tra ffi c stop makes the attorneys’ defense of any case much more di ffi cult. Other than moving violations, the four most used violations by o ffi cers to validate a potential, otherwise “illegal” tra ffi c stop have to do with simple equipment violations that can be resolved rather quickly and inexpensively. Th e fi rst equipment violation relates to the “improper” covering of a license plate by a license plate frame. License plate frames are generally the plastic “frames” that are given out by most car dealers or that can be bought in any automotive store. New Jersey law prohibits a motor vehicle from having a license plate frame which conceals or otherwise obscures “any marking” on the license plate. Th us, if a portion of the words “New Jersey” or “Garden State” is obscured on your license plate in any way, a police o ffi cer has the legal right to e ff ectuate a tra ffi c stop. Th e second violation relates to items hanging o ff of your rearview mirror and other obstructions of the windshield and front side windows. New Jersey law prohibits the operation of any vehicle which is “constructed, equipped or loaded” so as to “unduly” interfere with the driver’s vision. New Jersey case law has held that items hanging from the rearview mirror could fall under the language of this statute. However, the statute also includes the existence of stickers, signs, radar detectors, navigation systems or any other device or mechanism attached to the front windshield. Th e third violation relates to tinted windows. Th e same statute that restricts the hanging of anything from the rear view mirror also has been construed to hold that tinted windows constitute such an obstruction of view and, as such, the tinting of any three of your front windows would constitute appropriate cause for a law enforcement o ffi cer to pull you over even where you have not committed a moving tra ffi c violation. Th e fourth violation relates to broken lights on your vehicle such as headlights, taillights, brake lights and signal lights. Even where you have not committed a moving tra ffi c violation, a law enforcement o ffi cer has appropriate cause to e ff ectuate a tra ffi c stop where he observes that one of your lights is not operational. It should be noted that the fi nes and penalties for these violations, in and of themselves, are not excessive. However, as is o ft en the case, the law enforcement o ffi cers, upon e ff ectuating a tra ffi c stop will then observe that the driver or passengers in the vehicle have violated other motor vehicle and/or criminal statutes such as driving while intoxicated (DWI), driving under the in fl uence (DUI), possession of controlled dangerous substances (CDS), possession of drug paraphernalia, open containers of alcohol in a vehicle, possession of a weapon or any other o ff enses which the o ffi cer may observe during a tra ffi c stop. Once you are pulled over for a valid reason, it is di ffi cult for an attorney to challenge the tra ffi c stop on the basis of articulable suspicion or probable cause.
