o you know how I feel right now? If any of you have taken a one week vacation to a beautiful, relaxing, hide-away island with your significant other, you will be able to empathize with me. Do you recall getting off the plane upon your arrival thinking you had a whole, full week ahead with a list of exciting things to do and accomplish? Didn’t it seem like the first few days lasted forever and went so slowly? And then Wednesday came. And even worse, Wednesday night! That dreaded day signified the beginning of the end of your special time. Debbie Downer’s favorite day was probably a vacation Wednesday. Inevitably, no matter how hard you tried to slow it down, the rest of the week would race by and the next thing you knew, you were on your flight home saying to yourself, “I’m not ready to leave yet! Where did the time go? I knew I should have gone away for two weeks!” So, it feels like Wednesday night for me right now. The first year and a half of my term seemed to move so slowly and I felt I had so much time ahead of me. And now, rather suddenly, it feels like time is rushing by so quickly. Although we have accomplished a lot together and have put a lot of new and exciting ideas in motion, I feel there is still much to be done.

While I would love to “stay another week”, I know that it is not possible. But, what a great trip it has been! As summer winds down, remember that time is a precious gift. Spend it wisely with the ones you love. And spend a little of it helping those in need. It will make you feel good inside. With that thought in mind, I would like to once again thank our generous, devoted members for always being there to support the community organizations with whom we have partnered. Once again, we provided a sizeable donation to the Monmouth County SPCA Pet Pantry at the Annual BBQ on the Beach at Martell’s this year. We also helped the United Way “Stuff the Bus” with our “Tools for School” collection. These school supplies got distributed to children in need, right in our own communities. Our PWB walked in the 4th Annual Celebration of HOPE walk and we raised money to shed light and help provide resources for individuals and families struggling with addiction, again, right in our own Monmouth and Ocean county neighborhoods. And lastly, a great thank you for those that brought non- perishable food to our Night of Honor meeting to support Foodstock. It is through these community outreach programs that we can make a true difference in the areas we do business in and it is a great feeling to give back!

There is a lot happening between now and the end of the year, and I’m hoping you’ll “stay on the bus” with me for just a little longer. We hope that you will all join us on October 3rd for a Young Professionals Happy Hour networking event at the Blackman showroom, and our Annual Elections on November 8th at Ferguson in Lakewood. And be sure to keep an eye out for registration information for our Installation on December 6th where I will officially turn over the keys to our new association President. I’m looking forward to seeing everyone at these events, and until then, savor the rest of your summer.

Several members also rose to the occasion this month in organizing a spectacular event, the Summer-Send Off, to benefit the Builders Political Action Committee (BPAC). Regardless of who wins the governorship, NJBA is working diligently with our members and coalition partners to prepare for the new administration as policies, procedures, and personnel will be changing in Trenton. On July 27th, we made a major stride in the goal to increase efficiency by relocating and downsizing NJBA’s headquarters to Sharbell’s Town Center development at One Washington Blvd., Suite

NJBA continues to host educational programs and provide access to affordable continuing educational training for professionals. On October 20th, NJBA will host its next educational program, a Legal Update Seminar, which will examine the latest legal issues affecting land use and development in NJ. Dear NJBA Members,

In a previous Dimensions article, I outlined my three-point plan for the Association - a focus on engagement, efficiency and education. I am pleased to report that we have made strides in all three areas and I look forward to building on the momentum we have generated. On the engagement front, NJBA members have been intricately involved in helping the Association on committees and task forces, and additionally with relaying information from the field to NJBA. Members recently expressed concern that building inspection delays were becoming a major impediment to building and that part of the issue was the lack of adequate funding at certain code enforcement agencies due to improper municipal budgeting. In response, NJBA met with the Department of Community Affairs (DCA) to discuss the issue. As a result of our meeting, DCA recently issued a finance notice to all municipalities and counties operating code enforcement agencies reminding them of statutory limitations on the use of building department revenue.

Following the election, the Legislature will enter the Lame Duck session, one of the most unpredictable periods for the NJ Legislature. NJBA will need to be particularly vigilant in supporting pro housing initiatives and fighting back any misguided proposals that would impact our ability to provide housing for the residents of NJ.

In conclusion, I thank our membership for their outstanding efforts in supporting our Association over the first 5 months of my Presidency and I look forward to leading the Association to new heights over the remainder of my term.

here are few cultural institutions that can combine the various aspects of home owners and business life in one setting. This past spring the marketing department of CMM Custom Homes had the opportunity to view this feat up close. It was during one of the biggest marketing pushes for the builders in our Builder 20 Program called Parade of Homes. It took place in Wilmington, NC, and it did not feel like marketing at all. It unfolded as more of a cultural phenomenon that the residents and businesses alike were able to relish in the common interest of homes and home building. A Parade of Homes in the Jersey Shore area will showcase more than just homes. It is an opportunity to celebrate the attractive features of our community including beaches, golf courses, dining and historic downtown areas. This event serves as a portal for the community to become more involved with the builders and an opportunity to see the impact that the builders have on the community. In addition, it delivers the message that our Shore Builders Association is comprised of quality, dedicated, professional builders.

Supporting local causes while displaying the tremendous effort, value, and impact that home building has on our communities is a phenomenal way to connect with our target demographic.

It was an exciting day for everyone, as literally hundreds of yellow shirts took to the boardwalk for this much-needed organization. The Professional Women in Building are proud to support causes that touch the lives of people right in our own neighborhoods. Speaking of touching lives locally, on September 30th from 10:30 AM to 12:30 PM, members of our PWB will be participating in

stories. Lunch will be served and the girls will participate in a career minded activity. We are looking forward to partnering with BBBSMMC to bring this program to their organization! eading into fall is always a bittersweet time of year for me. I love the summer because of all the great events and things to do around the Jersey shore this time of the year. But, the fall is such a great time for our association and some of the most important events for Shore Builders take place as the weather turns cooler.

I would like to once again congratulate all our award winners, who were recognized at our Appreciation Night a Night of Honor event on September 13th. The night was a fantastic celebration of those invaluable members that have worked tirelessly to ensure the longevity of our association, so once again, please join me in congratulating the following members:

In October, we will be gathering at the Blackman showroom for our Young Professionals Happy Hour. I invite all members (not just the “Young Guns”) to come out for some networking. We can’t stress how important it is to the success of your membership to come out to events and get to know other members. If you’re not sure about it, or would like us to introduce you around, let us know. Our membership committee is here to help you get to know other members so you can establish relationships within our industry. Our Annual Elections will be on November 8th at the Ferguson showroom in Lakewood. We will be asking members to vote for the new President, Officers, and Board members. This event is a casual networking atmosphere where you will have the opportunity to browse Ferguson’s showroom, meet up with friends and colleagues, and learn more about the hierarchy of our association.

As the holidays approach, we will be installing our new President, as well as our newly elected Officers and Board Members on December 6th. This is a wonderful time to get to know our association’s leadership, who are more than happy to talk with new (or existing) members about succeeding in our industry. • This is lower than other proposals drawn up by lawmakers, and it could be difficult to achieve. Regardless, if the corporate rate is reduced, NAHB will work to make sure that this will not hamper the Low-Income Housing Tax Credit. • The President and Congressional Republicans are working on a unified plan they hope to unveil this fall. • NAHB members are reporting that the availability of labor has become a major problem. • To address this issue, we are working with policymakers on developing legal ways for immigrants and temporary foreign workers to enter the construction workforce as demand for labor increases. • We have also launched the Skilled Labor Fund with other stakeholders. This fund will provide scholarships for students to attend construction training programs nationwide. • Plus, our job training affiliate, HBI, is a national leader for career preparation and job placement in the building industry. • Meanwhile, the Administration wants to expand “earn-while-you-learn opportunities,” such as apprenticeship and pre-apprenticeship programs. NAHB will help make sure that residential construction training is included within these programs. Workforce:

• NAHB has had several advocacy wins this year, especially on the labor front.

• Earlier this year, the U.S. Commerce Department announced two tariffs on Canadian lumber imports after the U.S. trade agreement with Canada expired in 2015. The department has postponed the

Our PWB were Too Inspired to be Tired on September 9th when they joined thousands of people in the 4th Annual HOPE Sheds Light Walk. Bulletin Board | 26 | www.shorebuilders.org membership is under 45 years old and only 5% of NAHB membership is under 35 years old. n June, NAHB celebrated its 75-year anniversary with a spectacular Gala in Washington, DC. Most of our Federation’s leaders and legends were there to celebrate NAHB’s storied history. A combination of strong leadership at the grassroots level, successful advocacy wins for our industry, and a general belief by the membership of strength in numbers, all helped propel NAHB to be the voice of the housing industry in our country. Today, however, NAHB faces a unique challenge to continue its success. The 2008 downturn damaged our Federation in multiple ways. The cyclical nature of the building industry has seen its fair share of ups and downs but 2008 was unique as it was paralleled with the largest generation just beginning to enter the workforce. Schools changed how they taught in the early 2000’s losing classes such as woodshop. There was a general negative connotation from the film industry with their depiction of all trades. Add in a generation that tends to view the world on how it relates to them individually, we are dealing with a massive labor shortage nationally and a new membership threat. The NAHB Membership Committee, led at the time by SBACNJ member Michael Kurpiel, noticed that the NAHB median age of 56 years old was rising steadily since the downturn. As a result, the NAHB Young Professionals Committee was formed to recruit, retain, and engage anyone under the age of 45. We are not the first group of Young Professionals in NAHB’s 75-year history, but the need to focus on this demographic and grow it is very important. Currently, 19% of NAHB

This Spring, the Young Professionals Committee Leadership met to formulate our strategic plan for the next 3-5 years. Here are some of the highlights: • The NAHB Young Professionals Award began last year with SBACNJ Treasurer Chris Amato being chosen as a Region A Finalist which was a tremendous achievement. The 2017 NAHB Young Professionals Award is currently accepting applications through September 29th. Anyone under 45 is eligible to be nominated. • NAHB One to Watch Awards were created in 2017 to showcase the impact Young Professionals have across our Federation. 10 NAHB committees and councils are offering a One to Watch Award. Apply or nominate someone today! • In October we will be hosting two Virtual Town Halls for Local Leadership and HBA Staff to have a national dialogue about the key issues facing our Federation for the next generation of our members. • If you are attending the International Builders Show in early January 2018, Young Professionals will have a greater presence than ever before. There will be numerous events including awarding the Young Professional Award, One to Watch awards, the YP Pro Party, and a new booth on the show floor. • Follow us on our NAHB Young Professionals Facebook page New Jersey is the only State in the Federation to have a Young Professionals Committee or Council in each of its Local HBA’s and at the State level! In fact, Shore Builders is recognized as one of the most successful examples of a Young Professional Committee nationally. potential to significantly impact development and redevelopment of contaminated and brownfield sites. Of note, DEP has proposed amendments intended to strip away traditional corporate protections against personal liability, and to impose liability on individual corporate members involved with remediation activities, through among other things revised certification signature provisions required for remediation documents. The amendments will curtail the use of alternative fill at contaminated sites, requiring specific DEP approval for placement of any alternative fill above existing grade. Additionally, the proposed amendments will expand the obligation of an LSRP to withdraw an RAO, even if that LSRP is no longer retained as such, re-opening the remediation case. While RAO’s are currently subject to re-openers, a retained LSRP will be required to withdraw an RAO within 30-days of learning that a remediation “may” no longer be protective if the LSRP is unable to confirm protectiveness in that truncated time frame. If the LSRP who issued the RAO is no longer

retained, she must withdraw the RAO. This change, if implemented, is likely to significantly increase the frequency of RAO withdrawals, creating uncertainty in the development process and leading to a host of practical concerns and issues for buyers and sellers of development parcels, their lenders and consulting professionals.

All multi-residence buildings that are not a part of redevelopment must have at least one roadway one foot above DFE. Additionally, whether redevelopment or new development, roadways or parking area serving a multi-residence building in a fluvial flood hazard area cannot be more that 1-foot below DFE. DEP references emergency vehicle access as justification for this limitation. Site Remediation Rules DEP released its long promised amendments to the Unregulated Heating Oil Tank (UHOT) program. However, the proposed amendments go well beyond UHOT and if adopted will result in various changes to the Administrative Requirements for the Remediation of Contaminated Sites and Technical Requirements for Site Remediation applicable to remediation cases under SRRA, the Spill Act, Brownfield Act, and ISRA. Unlike many recent rule proposals, DEP did not solicit stakeholder input prior to release of the non-UHOT portion of the proposal. Several of the proposed amendments have the

Bulletin Board | 25 | www.shorebuilders.org approval of a water dependent development; compatibility of surrounding development; DEP recently proposed amendments to rules applicable to its Land Use permitting and Site Remediation programs. Each rule proposal was published July 17, 2017 and has a public comment period expiring 9/15/17. NJBA intends to submit comments to DEP. Builders, developers and land owners should consult with their environmental professionals to assess what impact the proposed rule changes may have on planned development. Coastal Zone Management Rules This rule proposal follows DEP’s July 2015 amendments that consolidated the procedural Coastal Permit Program Rules and the substantive Coastal Zone Management rules into a one comprehensive set of regulations applicable to coastal development. The 2015 amendments focused primarily on the procedural provisions of the Coastal rules, while the current proposal addresses limited substantive provisions. Amendments to the Freshwater Wetland and Flood Hazard rules are also proposed. Of note, the Filled Water’s Edge Rule is proposed to be amended to allow applicants to demonstrate that water dependent use is not feasible at certain sites enabling DEP to authorize non-water dependent development. Feasibility factors include the length of water frontage on the site; corresponding area of upland to support water dependent use; the presence of special areas between the upland and navigable water that may preclude

the existence of contamination that may prevent implementation of a water-dependent use; and factually-specific conditions unique to the property that may be result in peculiar

This case involved attempts by several non-governmental organizations (NGO) to derail a solar energy facility approved for development on a closed and capped former landfill located in Stafford Township. In an unpublished decision, the Appellate Division rejected the NGO’s challenges, concluding sufficient evidence supported the decisions of DEP and the State House Commission to remove certain restrictions on the landfill to allow the solar redevelopment to occur.

The Scenic Resources and High-Rise Structures rules will be combined. High Rise structures will still be more strictly regulated, but some provisions currently applicable only to High Rise structures, such as the requirement that development be in character with surrounding development heights and residential densities or be in character with municipal comprehensive development patterns, will be made applicable to non-High Rise structures. The Coastal High Hazard rule is proposed to be amended to provide a limited allowance for development in V-Zones, applicable primarily to development in densely developed areas such as the Hudson River Waterfront Area and Atlantic City. The Flood Hazard Rules amendments will facilitate certain residential redevelopment in inland fluvial flood hazard areas. Under the current rules, sites developed with multi-residence buildings (building serving 3 or more units) must be served by an existing or new roadway elevated one-foot above the applicable flood hazard design flood elevation (DFE). Under the proposal, an exception exists for multi-residence redevelopment if it is not feasible to construct an access roadway that meets the elevation requirement.
