In addition, by modernizing our computing stations, we have made the jobs of our staff more efficient and effective, allowing them to work while on the road or in the office. The goal is to continue to leverage technology so that we can continue to do our job more efferently. Continuing with this, we have also invested in the software we utilize as well. Moving our storage and accounting to the cloud from a main frame and continuing to search out other modern software improvements will allow us to continue to expand our efficiencies. The goal is to continue to modernize our technology so that we can offer more value and options to our members in terms of member portals and payment options, with the ultimate goal of complete integration of all our systems. While all these improvements provide various degrees of improvement individually, the aim is that these gains will culminate into long term sustainability and cost savings for the association for generations to come. In addition to our reinvestment in our capital expenditures, the officers and board have also decided now was the right time to review our external marketing plan. The association has engaged the firm Design 446, a member

We are entering into my favorite time of year for the builder’s association. The time of year when we have such eminent events as the golf outing and Martell’s on the beach. This is the building industry’s season! Sales are rolling and construction is in full swing. Things are going well for our members, and for the association too! Six months into my presidency and I am reaping the rewards of the hard work the officers put in before me. With the previous years of success in increased membership, well-attended, successful events, and the formation of new sponsorship programs, myself, the officers, and board are excited to be able to reinvest in the association after years of needing to tighten our belts. Deferred maintenance can only go so far, and the need for new computer equipment and modernizing the technology we utilize was a big priority for me. I am pleased to report that we have implemented a technology replacement program. By staggering our computers to end their useful life at different times, we have minimized potential disruption and are able to spread out the cost to the association.

We are currently in the process of auditing what we have in place and the strategies we need, such as a new, modern website which will integrate with our technological upgrades mentioned earlier. Finally, with fear of sounding repetitive, I encourage all the members to get involved with our association. It has been my experience that what you get out of the association is what you put into it, and the members who have gotten the most out of it have been active contributors and participants. There is no better way to expand your network then working alongside fellow members

M

onday through Friday each and every one of us hits the ground running. Rising and shining, guzzling our coffee, to get to the office on time to start our workday. No matter what your morning routine includes, one thing we all have in common is our daily To-Do List, whether it’s written or mental. Once you get to the office, it always seems like what you thought you were going to accomplish turns into something completely different! That happens often at the Shore Builders office, you never really know what the day will bring. and necessary supporting documentation. During the meeting, we create a checklist of items that we will need to coordinate or follow up on. These items all get added to that “To-Do” list mentioned earlier. With eight active committees and at least one event each month, organization is key! Speaking of events, coordinating those is always a big part of our day. Whether it is a large, year-long planned event like the Golf Outing or the FAME awards, or a quickly planned, informal networking event like the Young Professionals enjoy, there are still many details that need attention. Calls to venues, member registration, making sure all the necessary supplies are purchased and on-hand, the list goes on. Depending on the schedule, there may be a committee meeting that will need an agenda

The days leading up to an event, especially the day of, are hectic however we do everything we can to ensure the program is executed as flawlessly as possible. There are always last-minute details, member requests, and issues that need to be followed up on. Fielding requests and phone calls from our officers, board, members, vendors, and community organization partners are a part of our day, every day. Sometimes it isn’t easy to accommodate all of these requests; however, we strive to do everything we can to make sure our association members and partners are a priority. Chris and I enjoy hearing from you, we are here to answer any questions you have and to help you make the most of your membership experience. Working for a trade organization we face the same challenges as our members! We all wear many hats and often change them several times in the course of the day. Just a typical day… that reminds us how much we love our jobs!

These meetings were excellent. Having the opportunity to discuss housing and getting important messages across to our nation’s leaders to help the people of our industry and our economy is an amazing feeling.

It is very rewarding to be a part of the association in a way that helps bring to light the importance of homebuilding to our nation and create a positive impact.

Here are some of the highlights of the meeting: • Our delegation met with the Secretary of the Treasury, Steven Mnuchin. During our time with the Secretary, we were able

One of the most important topics during these meetings was the tariffs on Canadian lumber that is affecting our industry. In an article by NAHB Chairman Randy Noel states, “The fact that the National Association of Home Builders is so respected in Washington, D.C. is that the secretary of Housing and Urban Development, the Federal Reserve chair, the secretary of the Treasury, our U.S. trade representative and the vice president of the United States all want to hear what we have to say. They want to talk about our issues and really get something done. That’s unprecedented, and it shows you the importance of housing.” We were able to convey the message about the price and availability of lumber and the challenges it has created for builders, its effect on our economy, and housing affordability. NAHB is the voice of housing and is well respected for the powerful impacts housing has on the economy.

his past May I had the honor of joining the Senior Officers of NAHB in attending the NAHB Spring Executive Board Meeting in Washington, D.C. The itinerary for the week included a series of high-level meetings with government representatives, a briefing at The White House, and a trip to Capitol Hill. In addition, HUD Secretary Ben Carson addressed the Executive Board at its meeting. Our association is fortunate in that we had several local members representing our interests at these meetings, including myself, as well as Rich Robinson, Member Rebate Program who is the NAHB Young Professionals Chair, and Dave Bossart of Bossart Builders and NAHB NJ State Representative.

COMMITTEES

Committees are a vital functional of our Association. Make your membership more meaningful by getting involved.

Become an active member of a committee! Committees general meet one hour, once a month

 ASSOCIATE MEMBERS: This committee works for the betterment of all associate members. This committee is responsible for the BEAM (Builders Employing Associate Members) Award as well as the SBACNJ and NJBA Associate of the Quarter nominations.  BY-LAWS, POLICIES, PROCEDURES & ETHICS: This committee has been formed to review and update the SBACNJ bylaws, when necessary, as well as set policy for the betterment of the Association.  GOLF CLASSIC: This committee meets 6 times per year, beginning in February, to plan the SBACNJ Annual Golf Outing. As a committee member it is important to be available the day of the outing to work as an event volunteer.  LEGAL/LEGISLATIVE & ENVIRONMENTAL: This committee interfaces with local and state municipalities to maintain good relations, provide exchange information flow, and oppose adverse government regulations on the building industry in Monmouth, Ocean, Middlesex and Mercer Counties. The committee considers challenging ordinances, practices, and policies of municipalities which are harmful to SBACNJ members.  MEMBERSHIP SERVICES AND PROGRAMS : This committee recruits new members, screen prospective applicants, retains current members as well as conducts new member orientation and special membership drives.  SALES & MARKETING: This committee promotes professionalism in sales and marketing and further educates the members on the latest ideas available to Builder and Associate members. This committee also plans the Annual FAME (Fabulous Achievement in Marketing Excellence) Awards Banquet. The committee keeps industry views before the public and creates a better public image of the Association and the role it plays in the community.  MARTELL’S: This committee promotes professionalism in responsible for setting up and running the Builder Dune Buggy Race the evening of Martell’s BBQ on the beach. As a committee member it is important to be available the day of the event.  YOUNG PROFESSIONALS: This committee promotes participation and increases opportunities for young professionals in the building industry by developing interesting programs that provide a forum for networking, continuing education, professional growth, development of leadership skills and access to a professional community.  PROFESSIONAL WOMEN IN BUILDING COUNCIL: This council is recognized and chartered by NAHB and is dedicated to promoting, enhancing, and supporting home building and women in the home building industry. This council is open to all member companies and their employees. There is a fee of $50 per member to join the council and is open to men as well. n February 28th, we’ll be embarking on a journey around the world in celebration of the sales and marketing successes of our friends and colleagues. The Fabulous Awards in Marketing Excellence (FAME) will once again be held at South Gate Manor in Freehold. This year, we’ll take you to exotic destinations throughout the night, beginning with our extended cocktail hour. Network with over 200 of the industry’s top sales and marketing professionals as you dine on a variety of international cuisines. Once inside our event room, we’ll reveal the winners in each category. This is one of the most exciting nights for Shore Builders Association!

Our Call for Entries will be available this summer, so be sure to get your photography ready so that you can enter your projects for a FAME Award. In addition, we’ll be celebrating our sales professionals with our Million Dollar club awards. During the Atlantic Builders Convention in April, Shore Builders Association Officers spent time walking the showroom floor to thank our members for exhibiting. There were 59 exhibitors from our local down at the convention this year. Associate members also donated their time to help out at the Membership Booth and encourage non-member attendees to join one of the four locals. Volunteering time at events, and on committees is the best way to meet other members and establish long-lasting business

new members on July 11th, before our next committee meeting. We also discussed a plan to provide a new member orientation program, and details will be provided once this event is finalized. Joining committees and meeting fellow committee members strengthens membership and creates an environment where member retention remains high. We would like to encourage all Associate members to join a committee and be engaged! An affiliate membership for an additional employee who would like to participate in the association for future leadership roles. When your company joins the Shore Builders Association, one member is assigned as the “member of record”. This is the person who will receive all communication on events, programs, and association news. We recommend adding those employees who will be most engaged in the Association as affiliate members. he goal of the Membership Committee

is not only to increase members for our Association, but to retain our existing members by offering programs and opportunities to keep them engaged, as well as offer value for their membership fee. We also promote and encourage our Associate members to have a voice by joining committees, and attending events where they can network with other members, including Builder members, to help build relations that can increase their business. We started off the first half of the year with many events for the Associates to attend including the annual Economic Forecast, FAME Awards, and a Young Professionals meet up in April. We also encouraged members to attend the recent Yappy Hour Happy Hour at our member Vito Cardinale’s new Green Leaf Pet Resort, which all the proceeds went to raise funds for the NJ Chapter of the Leukemia and Lymphoma Society to support our fellow member Danielle Bagdzinski in her 10-week fundraising campaign. There were many Associate members who attended the annual Golf Outing and had a chance to play, socialize with other members, and enjoy the beautiful “hot” day. This event was sold out early for golf, and attendees celebrated the season with the Summer Kick Off dinner, immediately following the day of golf.

The Associates Committee had their first meeting and a lot of ideas were discussed about how we can offer more value to the Associate members. We are planning to have our first breakfast to welcome relationships. The Associates would like to congratulate and recognize Arvo Prima who received the Above and Beyond Community Service Award for HOPE Sheds Light during the SAM Awards at ABC. We would also like to congratulate Corey Wescoe and Tony DiLodovico on becoming Life Directors.

FWH Associates

Another important community resource, the Collier Youth Home in Red Bank, has been an organization we have partnered with in the past. The residents are young girls not living with their families, and PWB will providing the girls with mentoring one night a month. Each mentor night will allow a PWB member to share their experiences in life and business. These sessions are informal, in a conversational setting where the girls feel comfortable asking questions and interacting with our members. As you may know, BLSJ Member Winfield (Ziggy) Ziegenfuss is building a group home for physically and mentally challenged adults for the Arc of Gloucester in Glassboro, NJ. It will provide a home for four residents, one of which will be Ziggy’s son, Gabriel. The house is currently in the framing stage, but when it is ready for painting, the PWBGS will be there with paintbrushes in hand! We are looking forward to this project, which we will dedicate as part of our Women’s Build Day efforts. One last note about something that is near and dear to our hearts. Past SBACNJ President, Tom Bovino’s son is performing 3 days this summer to raise money for Foodstock & the SPCA. Eric Mason is his stage name and he will be performing three dates, in three venues for charity. Bulletin Board | 15 | www.shorebuilders.org Once again the PWBGS has formed a walk team for the HOPE Sheds Light 5th Annual HOPE Walk, Saturday, September 8th on the Seaside Heights boardwalk. We are so proud of our PWB member, Danielle Badgzinski for her tireless efforts on behalf of the Leukemia and Lymphoma Society’s Man and Woman of the Year Campaign. She spent 10 weeks fundraising on behalf of this charity in support of cancer patients and research to increase survival rates. She raised over $40,000, and the campaign overall raised more than $500,000. This campaign culminated in the Gala Event, which took place on June 20th where the Man and Woman of the Year were announced. Congratulations Danielle! he Professional Women in Building of the Garden State (PWBGS) continues to grow as we strive to branch out to include members from all of our state’s local associations. With growth comes the ability to provide our members with more networking, education, and philanthropic opportunities. The philanthropic arm of our chapter is focused supporting our PWB members with their charitable efforts – including the LLS Person of the Year, HOPE Sheds Light Walk, Jar of Hope, Tools for School, Foodstock, and mentoring at the Collier Youth Services Group Home among the many. The best part about these initiatives is that we can rally the rest of our association to create awareness among our members.

We are partnering with NJBA to make a bigger team than last year, with a fundraising goal of $7,000 to help provide resources to families affected by addiction. Please consider joining our walk team, or donating to help us reach our goal. More information is available here. Jar of Hope is an organization that raises awareness for a childhood disease called Duchenne Muscular Distrophy. There is currently no cure for this debilitating and fatal disease. Our Past President Corey Wescoe will be running the New York Marathon this fall to raise funds for this cause. Not only can you make an online donation , there will be a jar for collections at the Annual BBQ on the Beach and Dune Buggy Races on July 19th at Martell’s Tiki Bar in Point Pleasant. Please consider donating while you’re at the event. Every year since our council was formed, we have supported the United Way’s Tools for School campaign, and this year we will be collecting school supplies again. We will announce the member drop off locations and ask that you help us grow our efforts to help children in need go back to school with supplies including backpacks, pencils, pens, paper, notebooks, etc. Once again we will be collecting non-perishable foods at the November General Membership meeting to help Foodstock provide groceries to families in need.

She raised over $70,000 in a 10-week period to benefit research and patients afflicted by blood cancers. As you know, this is very near and dear to our hearts as our Executive Officer Gina McNamara’s mother passed away last year from this disease. Georgette then nominated fellow PWB member, Danielle Bagdzinksi to campaign for Person of the Year for 2018. We are so proud and please to announce that Danielle raised over $40,0000, contributing to a total of more than $500,000 for the overall campaign. The Young Professionals Committee is supporting Builders League of South Jersey Member and Past President Winfield (Ziggy) Ziegenfuss in the construction of a group home for Arc of Gloucester for four consumers, one of which will be Ziggy’s son. Many NJBA members, include several of ours are contributing time, materials, labor, and/or cash donations to support this effort, including Pittenger Builders, CMM Homes, EAM, All County Enterprises, and Ferguson. In addition the PWB has committed to helping with the painting of the interior of the home for Women’s Build Day. 2018 is half over and the Young Professionals Committee is on a roll. We have plenty of balls in the air this year, with our engaged members keeping our initiatives moving forward. We have made much headway in our plans for a PAC fundraiser, the Ocean County Vocational Technical School (OCVTS) mentoring outreach, and our efforts to support the ARC house that BLSJ Member Ziggy is building. In addition, we have an exciting update to our plan for a Young Guns versus Rusty Guns competition! The Young Professionals would like to invite you to our PAC fundraiser on Wednesday, August 15th from 6-8 pm at the Silverball Pinball Museum in Asbury Park. In the past, this has been a sold out event benefitting Shore Builders Association Political Action Committee. This year Shore will be contributing to the NJBA PAC, to help support critical legal and legislative initiatives on behalf of our industry. Not only will you be helping protect our industry, you’ll enjoy unlimited gaming, food, beer, wine, and water in a fun, casual networking atmosphere. Registration and information will be available soon. I hope you’ll save the date for this fun event. Another important initiative we have been working on as a committee is enhancing our involvement and relationship with the OCVTS in the form of mentoring programs. We are working with our staff contact, Christine Karaska, and have formed a subcommittee

to discuss our involvement, which we are hoping will include internships that can lead to full time employment, shadowing opportunities, and including students in some of our events for networking and professional development skills. Some of our members were very excited to be able to attend a recent Habitat for Humanity house dedication in June, which the OCVTS was involved in the construction of the home. We look forward to bringing more opportunities and mentoring to these students in the near future. As many of you may know, Builders League of South Jersey Member and Past President Winfield (Ziggy) Ziegenfuss is building a group home in Glassboro, NJ for physically and mentally challenged adults for the Arc of Gloucester. It will provide a home for four consumers, one of which will be Ziggy’s son, Gabriel. The home is currently in the framing stage and is expected to be completed this fall. Many NJBA members, include several of ours are contributing time, materials, labor, and/or cash donations to support his effort. This is an ongoing charitable initiative, but we would like to thank those who have donated to this cause, including Pittenger Builders, CMM Homes, EAM, All County Enterprises, and Ferguson. We will be sharing more information as the details are worked out, but our Young Professionals are very much looking forward to showing the Rusty Guns who the boss is at this event! And last, we would like to congratulate some of our Young Professional members on their participation in some fundraising and charity events that are near and dear to their hearts. Danielle Bagdzinski was campaigning for the Woman of the Year for the Leukemia and Lymphoma Society. Her campaign raised over $40,000 and culminated in a gala event on June 20th. For 10 weeks she hosted events, fundraised, and work hard to support LLS and we are so proud of her efforts! In addition, please consider Corey Wescoe in his New York Marathon run this fall. He will be raising money for Jar of Hope, a charity that supports children with Duchenne Muscular Distrophy. He has raised over $11,000 so far, and you can learn more about this charity here. As you can see, the Young Professionals Committee has been busy this year and continues to push forward our agenda of supporting community organizations, our industry, and each other. Beach in Monmouth County, Point Pleasant Beach in Ocean County, and a number of municipalities in Cape May County decided to adopt preliminary FIRMs, rather than awaiting FEMA’s remapping. As a result, these towns must specifically adopt the new FIRMs by ordinance effective on or before June 20, 2018. Neighboring municipalities not adopting the new FIRMS but located on the same FIRM panel as an adopting municipality must amend their effective ordinance to reflect the new panel date of June 20, 2018, for consistency. This is not the same as adopting a new FIRM map however. FEMA anticipates releasing the new final maps in 2021, which should be adopted in 2022. Similarly, the National Geodetic Service anticipates replacing the North American Datum of 1983 (NAD 83) and the North American Vertical Datum of 1988 (NAVD 88) with new datums in 2022. DEP updated its Immediate Environmental Concern (IEC) Technical Guidance in May 2018 (Version 2.0). Specifically, Section 4.1, Potable Well IEC Technical Guidance Procedures, was revised by the addition of a new Subsection 4.1.1, Identification, detailing the obligations of an investigator when contamination is discovered in a potable well, which is either a public supply well or a production well, that is used for human consumption. This update to the IEC guidance comports with DEP’s existing Off-site Source Ground Water Investigation and Comingled Plume guidance. Nonetheless, builders/ developers engaged in due diligence review of redevelopment parcels and their consultants should familiarize themselves with this update and with the IEC notification requirements under SRRA applicable to persons responsible for conducting remediation and LSRPs. DEP RELEASES UPDATED IEC GUIDANCE

this decision, since other “Mount Laurel” judges in New Jersey will undoubtedly rely upon Judge Jacobson’s decision outlining in detail the methodology used to calculate the number of affordable housing units that municipalities will be obligated to provide. SPILL ACT LIABILITY: CORPORATE VEIL-PIERCING Morris Plains Holding v. Milano French Cleaners In a recent unpublished decision, the Appellate Division upheld the imposition of liability under the Spill Act on the sole shareholder of a dry cleaning business. The plaintiff in Morris Plains Holding VF, LLC v. Milano French Cleaners, Inc., the owner of a shopping center that had assumed the cleanup of contamination, filed suit against a dry cleaning tenant and its sole shareholder after the defendant dry cleaning business failed to complete the remediation, closed, and filed for bankruptcy. Apparently there were no issues regarding the validity of the corporation. However, the trial judge held the sole shareholder jointly liable with the corporation for all remediation costs. pierced the corporate veil. The Appellate Division disagreed, finding the evidence produced at trial “firmly established” the judge’s findings that the sole shareholder was “everything vis-à -vis this business: its sole shareholder, the operator of the business, the person responsible for overseeing and handling the PCE used, and the person charged with ensuring legal and regulatory compliance.” Because the Spill Act broadly imposes liability on persons “in any way responsible,” N.J.S.A. 58:10–23.11f(a)(2)(a), the court found legislative intent to “expand the scope of liability without regard for corporate veils and the like.” Relying on the “in-any-way- responsible language,” the court rationalized that the legislature did not intend for a shareholder of a close corporation to pollute On appeal, the shareholder argued that imposing Spill Act liability on him improperly

The court’s broad imposition of liability and seeming disregard for the corporate veil could be noteworthy for owners of small businesses faced with potential environmental liability. The court’s holding may lead to an erosion of the corporate form as a shield to individual liability under the Spill Act where there is a “reasonable nexus” between the discharger and the contamination. The decision should be Interpreted in the context of the underlying facts, which involved the sole shareholder wearing many (or in this case all) hats, including the handling of the constituent contaminants and causing the discharge that required remediation. Regardless of the underlying factual setting, the decision likely will motivate plaintiffs in environmental cost recovery actions to pursue individual shareholders. After Super Storm Sandy, FEMA issued advisory maps in advance of the preliminary maps to help guide rebuilding efforts. When these advisory maps were issued for Atlantic, Hudson, Monmouth, and Ocean counties in late 2012, residents and officials were surprised by the substantial expansion of the V-zone and argued that FEMA did not take town and neighborhood-specific conditions into account. Since the V-zone has significantly stricter building standards, the advisory maps had costly implications for rebuilding. In June 2013, however, FEMA released preliminary flood insurance rate maps (FIRMs) that reduced the V-zone depicted in the advisory maps by at least forty-five percent. In 2017, municipalities were given an opportunity to adopt the preliminary FIRMs or await the final maps. NEW DEP COMMISSIONER

AFFORDABLE HOUSING METHODOLOGY I/M/O Princeton andWestWindsor

The Senate Judiciary Committee unanaimously supported approval of Catherine McCabe as the new Commissioner of DEP, voting the nomination out of Committee on May 14, 2018. The full Senate is expected to consider McCabe’s nomination as early as June 7, 2018. During the Judiciary Committee interview process, Acting Commissioner McCabe expressed concern regarding a number of issues including “New Jersey being a densely populated state”, “constant pressure on natural resources”, “New Jersey’s past industrial history”, “decaying water infrastructure”, “drinking water contaminants”, “Governor Murphy’s steps regarding climate change”, “directing DEP and BPU to rejoin RGGI”, and the importance of avoiding “building in the flood plains”. She also stressed the need to hear and share different views and perspectives and apply balance in any DEP decision-making, stating that the Administration would focus on continuing to implement common-sense in the decision-making process while putting a premium on customer service to minimize delays in business opportunities. It remains to be seen how this balance will be implemented and achieved throughout Commissioner McCabe’s tenure under the current Administration.

In March 2018, the New Jersey Superior Court of Mercer County issued a lengthy decision that could have broad implications for municipalities with respect to their affordable housing obligations. The decision, In the Matter of the Application of the Municipality of Princeton and In the Matter of West Windsor Twp., is the first case to apply a specific methodology for the apportionment of low- and moderate-income housing obligations within the State. The decision also set new-construction affordable housing obligations for Princeton and West Windsor, each of which did not settle its litigation, of 753 units and 1,500 units, respectively. Assignment Judge Mary C. Jacobson’s decision and order establishes the methodology and fair share affordable housing obligations for Princeton and West Windsor’s Third Round housing cycle, which encompasses the Gap Need (1999-2015) and the Prospective Need (2015-2025). As a result, each municipality must create a housing plan that provides a realistic opportunity to satisfy its affordable housing need. These plans will be considered at separate compliance hearings that Judge Jacobson has scheduled for late July 2018. Municipalities around the State that have yet to settle their cases had been awaiting
